Illegal Fan Fraud case 01 "Alien Base" invaded Taiwan's largest breeding area, sucking money to kill investment, and Changhua County government counseling was legal.

Fangyuan in Changhua is an important aquaculture town in Taiwan. On a plot of 10 hectares of land in the Wanggong aquaculture area, a wind farm composed of 432 metal self-axial turbines has grown, which is named "Alien Base" because of its special appearance. It has become a hot spot for NetMei to take selfies. However, this is a super-large illegal building that has not been legally applied for construction. It is not only a pain in the hearts of local farmers, but also a green energy fraud case.
Operators illegally built wind turbines on farming land in agricultural areas, and later obtained approval from the Energy Bureau for the development of green energy. it is absurd that fishermen reported when the fan was built. Changhua county government not only did not order the suspension of work to restore the original state, but allowed the construction to be completed, and began to guide the industry to be legal on the spot.
The operators took the government approval documents and collected investment in the name of "wind money" for a fan with hundreds of thousands of prices. after successfully absorbing the money, they sold all the site equipment to other companies, and the person in charge lost the money, and the new takeover company did not recognize the past, and there was no way for investors to complain. In the face of the construction of wind turbines on aquaculture land, Lin Jimin, chairman of the Changhua Culture Association, believes that the government should give fishermen an explanation and should be able to dismantle the fans so that aquaculture areas can resume their use.

Illegal construction fans drilled loopholes in laws and regulations, cut 72 pieces of 10 hectares of land, and obtained high benefits.
The base of this illegal wind turbine case was originally a 10-hectare farming land, which was divided into 72 small plots of land, each of which is about a little more than a penny (1250 square meters). The purpose of land subdivision is to take advantage of loopholes in laws and regulations to gain improper benefits from wind turbine investment.
The non-urban land use control rules allow certain space for the construction of facilities for agriculture, fisheries and animal husbandry land, which can be used as telephone poles, high-voltage towers or pumping stations, including renewable energy facilities, with an upper limit of 660 square metres per piece of land. In accordance with the law, a sum of 10 hectares of land can only build a facility of 660 square meters, so the operators will divide the land into 72 small plots of land, each with 660 square meters of facilities.
Then, operators install "six" small turbines on each piece of land, and the total power generation is 18 KW, which is deliberately "below the 20KW distance", which is also full of profit. In order to encourage all people to participate in power generation, the wholesale purchase rate for renewable energy in 2017 is 8.97 yuan per kilowatt-hour below 20KW, and only 2.80 yuan per kilowatt-hour above 20KW. In short, operators "disguise" 72 small-scale private power generation projects in order to gain nearly three times more power generation benefits than large power producers.
Although the division of land is the right of the operators, under the green energy development model of "allowing the use of 660 square meters," the operators should still apply to the local government, but the operators started construction without applying. When the operators were secretly involved, they were reported by local fishermen for illegal construction, and the illegal development was first exposed.
According to the map, the small wind farm is divided into 72 plots, each with a size of about 1200 square meters. Taken from the land information website
There are six fans inserted in each small plot of land.
Aquaculture Development Association: the largest and best aquaculture area in the country, can it be exploited one by one?
This wind farm, which is called "egg beater" by locals, is surrounded by a 300-hectare aquaculture area. This 10-hectare aquaculture land falls into the hands of operators, who illegally started construction of wind turbines in August 2017. Nearby fishermen questioned why the construction of a power plant could be started in the aquaculture area, which immediately responded to the Changhua County Aquaculture Fisheries Development Association, which issued a report to the county government.
After the aquaculture association reported, the county government began to punish the operators in October 2017, but did not order the operators to stop work and let the operators cover all the way to the end. It was not until May 2018 that the county government imposed the second penalty, but all 432 small fans have been completed. Lin Jimin was indignant about the attitude of the county government:
"We sent a document to the county government a long time ago at the start of construction, but the county government did not actively manage it. It should have all been dismantled and re-handled in accordance with the procedures, but now it is legal to give it to him on the spot."
Lin Jimin, chairman of the association, who was elected as one of the top ten outstanding fishermen in 2005, has long been concerned about the environmental problems of the western coast. Lin believes that the Wang Gong aquaculture area, the Fubao aquaculture area in the north and the Yongxing aquaculture area in the south have connected nearly 1300 hectares to become the largest aquaculture settlement in the country and should not be easily destroyed.
"aquaculture areas give priority to aquaculture operations and give full play to their advantages in specialization and scale. We have no objection to the government's provision of symbiosis projects for fishing and electricity, but we must also follow legal procedures, and we still have to use aquaculture. However, in this case, the aquaculture land is filled with fans, and this land can no longer be used for aquaculture." Feeling puzzled, Lin Jimin denounced the government and operators for arbitrarily fooling the law.
Lin Jimin, chairman of the Aquaculture Fisheries Development Association, is active in local public affairs and used to serve as Fangyuan Anti-Guoguang Petrochemical self-help Association.
Using the green energy policy as a verbal skill, a green energy scam carefully arranged by businessmen
In addition to destroying the breeding grounds with illegal fans, operators have even carried out black-hearted fraud with Green Energy, soliciting investment everywhere in the name of 'profit coins' for hundreds of thousands of dollars, and then transferring the site equipment to other companies after successfully absorbing money, and the person in charge absconded with the money.
Ting, one of the investors in the green energy scam, took out her savings to invest because she knew the relatives of the head of the company. She explained to reporters that ─, a developer at that time, Rich Star Group. According to the "contract for the purchase and Sale of the third Type of Wind Photovoltaic Power system" signed by Taiwan Power, it shows that Taiwan Power has been purchased for 20 years, and the wholesale purchase price is nearly NT $9 per kilowatt-hour, ensuring a big cake of stable revenue in the future. Win the trust of investors.
According to the "WGGT Wind Coin White Paper" provided by Ting, Zhaobang converts the expected income from the development of each wind farm into the company's income, and the investor converts the actual investment amount into the purchase of "wind profit coin", claiming that each issue of the company's income will be transferred to the investor's network account.
In addition to showing Taiwan Power's 20-year power purchase contract, Zhaobang also brought its customers to the scene to see the real scene of the power plant. Ting recalled, "when she saw 432 small turbines in 2017, she was willing to invest the money because she saw it." she was persuaded by her friends to take out her savings to invest. However, the truth is that Zhaobang company did not actually put into operation, but re-sold the whole plant equipment to another industry, and the person in charge ran away with all the funds.
"one day the whole website and account will disappear, and I don't know where my money is going." Ting realized that he had been cheated. Ting does not know exactly how many investors have been deceived, but her friend's dream of making a fortune in order to mortgage the house for this investment project has not only come to naught, but the house has also been auctioned.
Ting cannot understand why Zhaobang has obtained the record of the Energy Bureau, signed a contract with Taiwan Power, and successfully completed the construction of a 10-hectare wind turbine field, but not only is it unable to operate and sell electricity, but Green Energy has become a hoax.
Changhua county government indulges operators to get on the bus first and then make up the ticket.
Since the Changhua County government received a report in August 2017, it not only did not order the operators to stop work, but sat back and watched the project continue until May 2018, when the 432 wind power units were all installed before a symbolic second fine of 80,000 was imposed, and under the pretext that it was legal to enter the project counseling, it was not ordered to be dismantled. From the illegal construction of wind turbines to a green energy scam, what is the role of the government?
Why did the relevant administrative units in this case, including the Agriculture Department in charge of agriculture and fisheries, the Lands Office that regulates land use, the Construction Department that regulates construction and development, and the ─ Economic and Green Energy Development Department, the most critical local authority for green energy industry, and the ─ Energy Bureau, the central green energy authority, why did they break the law all the way?

Department of Economic and Green Energy Development: the Central Energy Bureau has agreed to put on record that the county government has the responsibility to legalize counseling.
Zhang, head of the Green Energy Section of the Department of Economic and Green Energy Development, said that after the penalty was imposed in October 2017, operators had obtained approval from the Energy Bureau of the Central Ministry of Economic Affairs for the record in December 2017 and submitted their first development application to the county government in January 2018. Since the industry has been approved by the Energy Bureau for the record, the county government has the responsibility to guide the industry to legalize.
"at first, the operators wanted to apply for 72 plots of land within 10 hectares, each with an allowable use of 660 square meters, but after the county government conducted a review, it asked the operators to change the zoning of the whole district before they could develop," explains Chief Chang.
However, it is absurd that the operator was reported by fishermen's groups in August 2017, and the county government imposed a penalty in October. Instead of ordering the suspension of work and restoring the original state of the land, the operator was allowed to obtain the Energy Bureau's "consent for the record" and Taiwan Power contract in December. The development plan was submitted to the county government in January 2018 to be completed in May.
In short, the operators broke the law first, and the county government condoned the construction of the industry for as long as half a year, and the wind power plant was completed in May 2018. As a result, no one dared to demolish it after a fait accompli, the county government simply did not cut and penalized, instead advising the industry to propose a change and development plan for the whole district.
Lands Office: piecemeal division of land is the legal right of operators
The Green Energy Section of the Economic and Green Energy Development Office stressed that the county government guidance does not necessarily mean that it will be approved. According to the regulations of the Energy Bureau of the Ministry of Economic Affairs, it is necessary to obtain legal land changes, installation and installation, and pass the examination and approval of "equipment registration." only then can Taiwan Power purchase electricity from operators in accordance with the contract. If the operator is unable to complete the legal land change, then the operator will also bear the risk of loss.
However, in view of the obvious illegal use of the land, the Economic and Green Energy Office shifted the responsibility to the Lands Office. The Chief of the Land use Section of the Lands Office said that he had violated the zoning regulations in accordance with Article 21 of the Regional Planning Law and imposed penalties twice. However, after the operators applied for development to enter the compensation and correction procedures, "according to the usual practice, they will respect the target enterprise competent authority (Economic Green Energy Office) and give them time to strive for legalization."
The question is, when the beginners divided 10 hectares of land into 72 small plots of land, did the Lands Office have no doubt about the developer's intention to develop? Section Chief Wang only said: "unlike agricultural and animal husbandry land, there is a limit on the size of 0.25 hectares of land, and it is the legal right of operators to divide the land in bits and pieces."
The county government took the initiative to cover, connived at the loss of the land, and the public gate became an accomplice.
According to the division of labor, the Economic Green Energy Office can only accept the "preparation permit", and the land change is still handled by the Construction Department, but the Construction Department is also a unit for demolishing illegal buildings. Chen Weihong, acting director of the Construction Department, said at first that he "did not see this change case", and then changed his words. "it has been received, and the case is still in the supplement."
Chen Weihong then said frankly that "Green Energy is a franchise business, and the competent authority of the enterprise agrees and supports it before there is a change of land." Chen also said that the economic and green energy office of the competent authority of the purpose enterprise is the key, and the agriculture department, the environmental protection department and the construction department of other organs only cooperate with the procedures.
Can the greening of the county government erode the agricultural and fishing land, and the use of agricultural land has become empty talk?
In the face of the illegal occupation of fish fish land by wind turbines, the head of the Fisheries Section of the Agriculture Department in charge of agriculture and fisheries said awkwardly that "everything depends on the opinions of the Economic and Green Energy Department of the governing organ." Wang Jishi, the undertaker who first received the report, added: "from the standpoint of the Agriculture Department, the aquaculture area is a sea plough land that the government has invested a lot of budget to improve. It should be used as a professional culture and should not be developed in pieces."
Green Energy is the main policy in Changhua County, but Changhua is also a major agricultural and fishing county. In the face of Green Energy competing for land with agriculture and fishing, civil servants revealed a sense of powerlessness. "the central government lacks overall planning, and the Energy Bureau does not have a policy to guide land inventory. Energy operators have been developing agricultural, fishing and animal husbandry land everywhere. Similar incidents have occurred in all counties and cities, and as agricultural administrative units are quite helpless." (the article is not finished to be continued, please read on)
