Starting from today, the newly revised measures for the Administration of license for crop seed production and Operation (referred to as the "Licensing measures") will come into effect. There will be five adjustments in ① seed production and management.

In order to adapt to the new situation of the development of the seed industry and speed up the development of the modern seed industry, in November 2015, the National people's Congress examined and adopted the new seed Law, which adjusted the license management system of seed production and operation. This revision:

The first is to merge the seed production license and the seed management license into a seed production and operation license.

The second is to delegate the authority for examining and approving the seed production and operation license of the combination of breeding and production and management and the effective region for the whole country to the competent agricultural department at the provincial level, and delegate the authority for examining and approving the seed production and operation license of conventional crops to the competent agricultural department at the county level.

The third is to abolish the requirements of enterprise registered capital, the amount of fixed assets and the management of certificate before approval.

The fourth is to establish a record management system for seed production and operation.

Fifth, improve the enterprise seed production and operation file management system.

The integration of "two certificates" in ② and the establishment of a secondary certificate

The implementation of the integration of "two certificates" for seed production and operation is a substantial combination of seed production license and business license.

As far as the 2080 enterprises that have seed production licenses and business licenses at the same time are concerned, applying for only one license will greatly reduce the volume of administrative license examination and reduce the burden on enterprises; implement the supervision of the whole industry chain, with the enterprises with the right of seed processing and packaging as the main body, extending forward to seed production and backward to seed sales, which is conducive to strengthening the supervision after the event of licensing and realizing traceability management.

The license for seed production and operation shall be issued by the competent agricultural department of the place where the seed enterprise is registered according to its authority, and there is no need to issue the same type of license repeatedly in the other places of seed production and sale.

The situation of seed production in different places is common in seed production, the production varieties are updated year by year, and the production varieties and places change frequently.

The Licensing measures divide the license into the principal certificate and the secondary certificate, which shall indicate the license number, the name of the enterprise, the unified social credit code, domicile, legal representative, scope of production and operation, mode of production and operation, effective area, period of validity, license issuing authority, date of issuance, etc.; the secondary certificate shall indicate the crop type, seed category, variety name and approval (registration) number, seed production place, etc. The principal certificate and the secondary certificate are an organic whole.

The threshold for ③ enterprise registration has been lowered

The new "seed Law" cancels the financial conditions of the production and operation license, and the "license measures" abolishes the requirements of enterprise registered capital and license before license.

In the future, the registered capital will be changed from the actual payment system to the subscription system in the industrial and commercial registration link, and the enterprise shall bear the corresponding responsibility according to the registered capital it has subscribed; highlight the qualification conditions related to seed production and operation in the license examination and approval link, and arrange production and operation activities according to the plan to reduce the financial pressure on enterprise investment.

In the management of production and operation archives, the "license measures" highlight two aspects: one is to ensure traceability, and the other is to preserve seed samples.

Seed enterprises shall establish seed production and operation files including original records or certificates formed by seed field production, processing and packaging, sales and circulation, etc.

The archives of seed production and operation shall be kept for at least five years to ensure that the information recorded in the archives is continuous, complete, true and traceable. Seed producers and operators shall keep the seed samples produced and operated in batches, and at least keep such crop samples for at least two production cycles.

④ seed distribution stores implement record system

The seed Law has established a record-keeping system for seed production and management, promoting the transfer of administrative examination and approval from prior permission to post-event supervision. The Licensing measures stipulate that four kinds of common seed production and operation subjects, such as seed production entrusted in writing, seed sales entrusted in writing, seed management without sub-packing and establishment of branches, shall be submitted to the local competent agricultural department at the county level for the record; if no competent agricultural department has been established, it may be filed with the competent agricultural department in the administrative region at a higher level.

The content of filing mainly includes the basic situation of seed producers and operators and the relevant information about the seeds they produce and operate. The licensed seed enterprise is not the main body for filing, but if the licensed seed enterprise entrusts the production of seeds or the sale of seeds or the establishment of branches in writing, the licensed seed enterprises shall, when applying for a license or after obtaining a license, timely fill in the relevant information in the China seed Industry Information Network and generate a filing serial number to ensure that the entrusted party or subordinate branches can successfully complete the filing work.

There are restrictions on the serial exchange of ⑤ farmers' own seeds.

Article 37 of the seed Law stipulates that if farmers have any surplus of conventional seeds for their own use, they can sell or exchange them at the local market, and there is no need to apply for a license for seed production and operation.

After the implementation of the "licensing measures", the individual farmers, the region and the number of individual farmers will be further clarified.

The measures stipulate that individual farmers shall be farmers who have signed rural land contracts in the form of a household contract responsibility system; the local market shall be the township (town) area where the peasants are located; the number of seeds sold or exchanged shall not exceed the annual amount of seeds used by their households to contract land.
