How to compensate for homestead and house demolition?
1. Rural homestead and house demolition are compensated separately. "separate compensation" refers to the separation of land compensation and ground attachment compensation. The property right of the rural homestead is owned by the village collective, which is allocated by the village collective to the villagers, and the villagers build houses on the homestead to live. In the event of homestead demolition, there are two kinds of compensation. One is homestead compensation, the other is housing compensation. As the property right of the homestead belongs to the village collective, this part of the compensation is owned by the village collective and will not be given directly to the users of the homestead. The property right of the house belongs to the villagers, so the house compensation belongs to the villagers. 3. Article 47 of the current Land Management Law provides that compensation shall be given according to the original use of the requisitioned land. The land compensation fee for the requisitioned cultivated land shall be six to ten times the average annual output value of the three years before the cultivated land is requisitioned. The resettlement subsidy for requisitioned cultivated land shall be calculated on the basis of the number of agricultural people who need to be resettled. The number of agricultural population that needs to be resettled shall be calculated according to the number of cultivated land requisitioned divided by the average amount of cultivated land occupied by each unit before land requisition. The standard of resettlement subsidy for each agricultural population in need of resettlement shall be four to six times the average annual output value of the three years before the cultivated land is requisitioned. However, the resettlement subsidy per hectare of requisitioned cultivated land shall not exceed 15 times the average annual output value of the three years before the requisition.
4. The compensation price for house demolition consists of the compensation price for the location of the homestead and the new price for the house to be relocated. The calculation formula is as follows: housing demolition compensation = homestead location compensation price * homestead area + replacement of demolished houses into a new price. With reference to the local ordinary housing guidance price, the homestead location compensation price is comprehensively determined by the district and county people's governments with reference to the average price of ordinary commercial housing in a certain area and urban planning. The area of homestead identified in demolition shall be legally approved and shall not exceed the control standard. The new average price of house replacement refers to the replacement of houses on demolished homestead in a certain period of time and in a certain area into a new average price, and the specific standard is determined by the district and county government in the range of 40000yuan / square meter according to the construction of rural housing in the aforementioned area. The resettlement area per household shall be controlled according to 100,150 square meters, and the specific standards shall be determined by the district and county government according to the local rural economic level and the living conditions of farmers.
