However, the across-the-board demolition that appears in the process of governance is unfair to most farmers, and the autonomy of production and management of land contractors should be fully respected, as long as they do not destroy the ploughing layer of cultivated land and do not destroy cultivation conditions, land contractors can independently decide to use cultivated land for aquaculture.

However, the across-the-board demolition that occurs in the process of governance is unfair to most farmers. According to the "National Land Classification" and "instructions on how to deal with the area of farming" formulated by the Ministry of Land and Resources, aquaculture land belongs to agricultural land, and the construction of aquaculture houses on it does not belong to the act of changing land use. The occupation of cultivated land other than basic farmland for aquaculture shall no longer be examined and approved on the basis of construction land or temporary land use. The decision-making power of the land contractor in production and operation shall be fully respected. As long as the tillage layer of the cultivated land is not destroyed and the cultivation conditions are not destroyed, the land contractor may independently decide to use the cultivated land for aquaculture.
As early as in 2007, the "notice on promoting large-scale Livestock and Poultry farming related Land Policy" jointly issued by the Ministry of Land and Resources and the Ministry of Agriculture strongly supported the pig industry, requiring all localities in land consolidation and new rural construction to fully consider the needs of large-scale livestock and poultry farming, reserve land space and provide land conditions. And focus on the transmission of a message: no place shall prohibit or restrict large-scale livestock and poultry farming on the grounds of new rural construction or environmental improvement.

Department of Land and Resources of provinces, autonomous regions, municipalities directly under the Central Government and * * production and Construction Corps (Department of Land, Environment and Resources, Bureau of Land and Resources, Administration of Land and Resources, Housing and Land Administration), Department of Animal Husbandry and Veterinary (Agriculture, Agriculture and Animal Husbandry, Agriculture and Forestry) Office (Bureau, Office, Commission): with the development of animal husbandry in China, great changes have taken place in breeding methods and structure, and large-scale farming has put forward new requirements for land use. In order to implement the "opinions of the State Council on promoting the Development of Pig production and stabilizing Market supply" and the "Emergency Circular of the State Council on effectively implementing policies to ensure Market supply and maintain the Stability of non-staple Food prices", and to promote the development of large-scale livestock and poultry farming, the issues related to land use are hereby notified as follows:
I. overall planning and rational arrangement of breeding land
(1) the department in charge of animal husbandry at the county level shall, in accordance with the development plan of animal husbandry at the higher level, the production basis of local animal husbandry and the conditions of agricultural resources, formulate a plan for the development of animal husbandry at the county level, define the development goal and direction, and put forward the requirements for the quantity, layout and scale of large-scale livestock and poultry breeding and its land use.
(2) under the circumstances that the current overall plan for land use has not yet been revised, the land and resources management departments at the county level shall discuss the issue of large-scale land for livestock and poultry breeding, do a good job in land use demonstration and other work in accordance with the current land use planning, and provide land security. In the next round of revision of the overall land use planning, it is necessary to make overall arrangements, incorporate large-scale livestock and poultry breeding land into the planning, implement breeding land, and meet the land demand.
(3) the planning, layout and site selection of large-scale land for livestock and poultry breeding should adhere to the principle of encouraging the use of unused land such as abandoned land and barren mountains and slopes, occupying as little or as little cultivated land as possible, and forbidding the occupation of basic farmland. In land consolidation and new rural construction, all localities can fully consider the needs of large-scale livestock and poultry breeding, reserve land space and provide land conditions. No place shall prohibit or restrict large-scale livestock and poultry farming on the grounds of new rural construction or environmental improvement. Actively promote standardized large-scale farming, reasonably determine the standard of land use, and save intensive land.
(4) after the land for large-scale livestock and poultry breeding has been determined, the land shall not be changed to non-agricultural construction purposes without authorization, so as to prevent the use of large-scale farming to enclose land for other non-agricultural construction.
Second, distinguish between different situations and adopt different support policies
(1) the rural collective economic organizations and the cooperative economic organizations of farmers and animal husbandry shall, in accordance with the overall plan of land use of townships (towns), manage the land needed for large-scale livestock and poultry breeding according to agricultural land for the adjustment of agricultural production structure, there is no need to go through the formalities of examination and approval for the conversion of agricultural land.
(2) other enterprises and individuals shall set up or jointly with rural collective economic organizations, farmers and cooperative economic organizations of animal husbandry to set up land for large-scale livestock and poultry breeding, and carry out classified management. In accordance with the management of agricultural land, production facilities such as livestock and poultry houses and land for greening isolation belts do not need to go through the formalities of examination and approval for the conversion of agricultural land; management and household housing, epidemic prevention and control facilities, feed storage rooms, hardened roads and other ancillary facilities, belong to permanent buildings (structures), and their land use shall be compared with the management of rural collective construction land, it is necessary to go through the formalities of examination and approval for the conversion of agricultural land in accordance with the law.
(3) the land use planning targets needed to go through the examination and approval procedures for the conversion of agricultural land shall be transferred and solved from the plan targets already issued this year, and will be arranged in the annual plan in the future; if cultivated land is occupied, in principle, aquaculture enterprises or individuals shall be responsible for replenishing it, and if conditions permit, it may also be supported by investment projects implemented by the people's governments at the county level.
III. Simplify procedures and provide land in a timely manner
(1) Enterprises or individuals applying for large-scale livestock and poultry breeding, whether they are rural collective economic organizations, cooperative economic organizations of farmers and animal husbandry or other enterprises or individuals, shall be subject to the consent of the township (town) people's government, submit an application for large-scale breeding projects to the competent animal husbandry department at the county level for the examination and filing.
(2) where the rural collective economic organizations, farmers and cooperative economic organizations of animal husbandry apply for large-scale livestock and poultry breeding, after the examination and approval of the competent animal husbandry departments at the county level, the township (town) land offices shall actively help coordinate the site selection of the land, and go through the formalities of land use record with the land and resources management department at the county level. If the occupation of cultivated land is involved, a guarantee for the restoration of cultivated land shall be signed, and no deposit or deposit shall be collected in principle; if it cannot be restored at the original site, the cultivated land shall be replenished in accordance with the law.
(3) where other enterprises or individuals apply for large-scale livestock and poultry breeding, after the examination and approval of the competent animal husbandry department at the county level, the land and resources management departments of the county (city) and township (town) actively help to coordinate the site selection of the land, and go through the formalities of land use record with the land and resources management department at the county level. Among them, if the land for production facilities and green isolation belt occupies cultivated land, a guarantee for the restoration of farmland shall be signed, and if the original site cannot be restored, the cultivated land shall be replenished in accordance with the law; if the land for ancillary facilities involves the occupation of agricultural land, the examination and approval procedures for the conversion of agricultural land shall be carried out in accordance with the prescribed limits of authority and requirements.
(4) the land for large-scale livestock and poultry breeding shall be obtained by leasing, subcontracting and other legal means in accordance with the laws and regulations such as the Rural Land contract Law, the Land Management Law and relevant regulations, so as to effectively safeguard the legitimate rights and interests of the land owners and the original right holders. The land and resources management departments at the county level shall promptly complete the investigation and registration of land changes after the relevant procedures for large-scale livestock and poultry breeding land have been completed. If the construction really needs to occupy the land for large-scale livestock and poultry breeding, it shall, in accordance with the planning and layout and the requirements of breeding enterprises or individuals, re-implement the new breeding land accordingly, and protect the legitimate rights and interests of breeding enterprises and individuals in accordance with the law.
IV. Work together to do a good job in the implementation of large-scale land for livestock and poultry breeding
(1) all localities should, in accordance with laws and regulations and the relevant provisions of this circular, conscientiously investigate and study in the light of local actual conditions, further improve relevant policies, refine relevant regulations, and actively provide good services for large-scale livestock and poultry farming land.
(2) Land and resources management departments and animal husbandry departments at all levels should, under the organizational leadership of the local government, perform their respective duties, strengthen communication and cooperation, promptly study the new situations and problems arising in large-scale livestock and poultry breeding, and constantly improve corresponding policies and measures to promote the healthy development of large-scale livestock and poultry farming.
(3) problems encountered by various localities in the implementation of this Circular shall be reported to the Ministry of Land and Resources and the Ministry of Agriculture in a timely manner.
