Last year, the Ministry of Agriculture held its first on-the-spot meeting in Zhejiang, which comprehensively sounded the bugle for cleaning up and rectifying "isolated nets" and "three no" fishing vessels. A year later, recently, the Fisheries and Fisheries Administration of the Ministry of Agriculture held another promotion meeting in Zhejiang, hitting the "isolated net" with heavy blows.

It is understood that as early as 2004, the Ministry of Agriculture promulgated and implemented the system of minimum mesh size of marine fishing gear. However, until today, illegal fishing gear is still becoming more and more serious, with a wide range of quantities and repeated prohibitions, which has become the "number one killer" of offshore fishery resources. Why is it so difficult to cure this stubborn disease?

Fishery law enforcement "dare not punish"

" Speaking of difficulties, Jing Nanjin, deputy director of the Liaoning Provincial Marine and Fisheries Department, came straight to the point.

Liu Zhenzhou, deputy director of the Hebei Provincial Agriculture and Industry Office, frankly said that fishermen who use illegal fishing gear such as "isolated nets" are usually socially vulnerable groups who make a living by fishing. Due to the lack of other employment skills and channels, fishery law enforcement departments are easy to conflict with their right to life, and the embarrassing phenomenon that "it is difficult to abide by the law" occurs from time to time.

Cui Fengyou, deputy director of the Department of Oceans and Fisheries of Shandong Province, told reporters that the rectification and cleaning of illegal fishing gear is not only a matter of a net, but also involves civil affairs, public security, justice, industry and commerce, and other departments. It is simply difficult to solve this "stubborn disease" by relying on a single department of fishery. It is necessary to take the lead of the party committee and government to form a long-term mechanism for joint law enforcement among various departments before it can be completely disintegrated.

It is understood that since 2014, Zhejiang, led by the provincial party committee and provincial government, has launched a "fishing ground restoration and revitalization project" and vigorously carried out a "one-dozen-three rectification" campaign in the province's coastal areas.

Who decides whether to break the rules or not?

At the meeting, a number of relevant responsible persons of the fishery departments of offshore provinces all talked about the current dilemma of "unknown standards." Take Jiangsu as an example, Zhao Jun, deputy inspector of the Provincial Marine and Fisheries Bureau, told reporters that in daily fishing administration and law enforcement, fishermen are often found to change their fishing gear into a variety of fishing gear, which does not correspond to the existing catalogue of permissible and transitional fishing gear, making it difficult for law enforcement personnel to rule on the spot, and in the Yangtze River and inland waters, there is no unified catalogue of gear names and mesh size standards.

So, who will identify the fishing gear suspected of breaking the law? Zhao Jun said that due to the lack or ambiguity of qualified fishing gear and fishing law appraisal institutions filed in the judicial department, the case was beset with difficulties and hit a brick wall everywhere in the process of transferring the case for investigation. "the catalogue of permitted fishing gear and the appraisal institutions of fishing laws all need to be clearly defined and made public as soon as possible, which are of great significance to the implementation of the linkage between fisheries and maritime police, public security, border defense, industry and commerce, and other departments."

It is understood that the current marine fishing gear catalogue standards in China are divided into three categories: permissible, transitional and forbidden. The most embarrassing thing is the transitional fishing gear, which has many vague concepts. In this regard, at the meeting, many places raised: it is easy to manage and implement, and whether it is possible to "not set up transitional fishing gear." Previously, such as Guangxi has passed local legislation to include some transitional fishing gear in the prohibited category, but in judicial practice, the courts often adopt national standards.

Who is in charge of the source of illegal fishing gear?

In the chaos of the whole "absolute household network," the most serious are electric pulses, multi-layer bag nets, ground cage nets, beach nets, and coral nets. Many conference deputies pointed out that tactically, "combination of thinning and blocking" must be adopted. only by controlling the production source of illegal fishing gear can we speed up and solve this problem. As the forerunner of the national crackdown on the "cut-off net", Zhejiang launched a "battle for the protection of young fish" in an all-round way at the beginning of this year. It is planned to spend a year to explore the establishment of a record system for the purchase and sale of catch through the supervision of the production and sale of fishing gear, so as to basically achieve the extinction of prohibited fishing gear and "dense eye bag net" on land, on board and at sea.
