Food safety is no small matter. In order to further safeguard the "safety on the tip of the tongue" of the people, the new Food Safety Law, which came into force on October 1, 2015, has made many adjustments to keep pace with the times, such as increasing penalties for violators in the food field. Article 135 stipulates that anyone who is sentenced to fixed-term imprisonment or more for a food safety crime shall not engage in food production, operation and management for life. "Food crimes are prohibited for life", which not only affirms the attitude of strict control, but also drives outlaws out of the market, which is tantamount to building an extra fence for food safety.

On April 7 this year, Beijing issued the first "ban" ticket after the implementation of the new Food Safety Law-- a food production enterprise in Tongzhou District was revoked according to law for false labeling of food labels, and the company was banned as a legal person for five years. It is said that this is the first domestic case of "hanging a license" and punishing the party concerned for employment qualification. Behaviors such as "premature delivery" of food labels and illegal change of expired food labels are "hidden rules of the industry" that have been repeatedly banned. In the past, because the value of goods in such cases was small and the test results were often qualified, most of the penalties were administrative penalties such as warnings and fines. If the punishment is not strong enough, "prohibition" is equivalent to cutting off the financial means of violators, and the intensity is not the same.

The complexity of the food safety situation in China is inseparable from the small, scattered and chaotic situation of the food industry-most of them are small enterprises, as well as countless small workshops and vendors. In view of this particularity, it is not easy to weave a comprehensive market supervision network to achieve seamless supervision without leaving a dead corner. Let's say that "food crimes are banned for life". For those who have previous convictions for food safety crimes, evasion is not difficult. If you "shoot one shot for another place", you can still work in the food industry. In particular, in recent years, the food ordering business has shown an explosive growth trend, online ordering has become a quite common way of life. Data show that as of June this year, the number of online takeout users across the country had reached 150 million, an increase of 31.8% over the end of last year. The advantages of online food ordering are self-evident, and its disadvantages should not be underestimated, and the risks are mainly reflected in food safety. CCTV once revealed that the online booking platform revealed "Ghost Restaurant": the licensed names and addresses of some restaurants were someone else's and had nothing to do with it. No one knows who is running a restaurant. Where do other regulators start? If the management is not in place, this will be a dead corner.

The regulations on the implementation of the Food Safety Law of the people's Republic of China (revised draft submitted for review), in view of the development of the online food ordering industry, strengthens the online food safety supervision, which can be regarded as a measure to make up for the deficiency. Compared with offline supervision, online food safety supervision is more difficult and requires higher control ability. For example, "food crime is banned for life" requires both offline and online supervision. Offline supervision, through big data, realizes the sharing of information between different regions and departments, ensuring that some food safety criminals who have been sentenced cannot return to their old jobs in another place after the end of their sentences; online supervision, mainly by the third-party platform for online food trading, they have the responsibility of real-name registration and examination of licenses for food producers and operators who enter the network. The question is, if the third-party platform does not fulfill its responsibility, or even knowingly commit it, what responsibility should the platform bear? I'm afraid this needs further refinement.

Severe punishment to deal with chaos, food safety can not be too strict. Laws and regulations come first, followed by regulation, and food safety is guaranteed.
