Series foreword: Taiwan is expected to promote the policy of "local creation". As the main implementation area of "local creation", "rural areas" need to have overall planning first, and after subject analysis and strategy development, then carry out spatial planning and resource investment to avoid a waste of resources caused by investment that does not meet the demand. In addition, when Taiwan quotes Japan's local creation policy, what is the actual resource input and local effect of Japanese governments at all levels? Need a deeper understanding.

In order to deeply grasp the rural development and local creation in the context of Taiwan's reality, upstream and downstream cooperate with the Foundation for the Development of Rural Law in a series of articles to explore the current situation in Taiwan and the policy trends in Japan. Local creation gives priority to the overall planning of rural areas

Only regulation, no plan.

In the past, the laws and regulations for the construction or development of rural areas were mostly general laws and regulations on land use and construction management, but there were no laws and regulations to regulate the overall construction of rural areas. The construction of rural areas involves the use of agricultural land, building management, public facilities, cultural landscape and rural ecological environment. If there is no special law, it is bound to increase the difficulties in implementation.

In view of the importance of the construction of agricultural and fishing villages or the development of rural areas, the Committee of Agriculture of the Executive Yuan studied the draft Rural Planning Law in 1994, because it involved powers and responsibilities such as land use control and building management. The Ministry of the Interior said at that time that the Ministry was working on the Urban and Rural Planning Law, so it advised the Council of Agriculture to postpone its formulation, but the Ministry of the Interior had not yet formulated the Urban and Rural Planning Law for many years.

In view of the importance of legislation on rural construction projects, the Council of Agriculture developed the Rural Regeneration Bill in 2009, which was passed by the Legislative Yuan in July 2010. At that time, the Council of Agriculture explicitly set up the "Rural Planning and Development Agency" in the Rural Regeneration Bill to be responsible for enforcement. all the relevant provisions were deleted because of concerns about enclosure, and the expectations of overall rural planning were short-lived. Rural areas and urban and rural areas returned to the lack of integrated planning.

Local creation should be in line with the land plan and promote the overall planning of rural areas.

At present, there are more than 4000 "non-urban rural areas" in the country (Note 1), because the characteristics and development needs of rural areas are not taken into account for spatial planning and resource investment. as a result, the countryside has fallen into the development predicament of poor environment, decadent buildings, declining industry and population loss.

Pleased to see that in order to solve the problems of Taiwan's total population decline, aging, over-concentration of population in metropolises and stagnant rural development, President Lai Qingde's first "Local Creative Society" held on May 21, 2018, after listening to the briefing on "the preliminary Conception of China's Local creation National Strategy" put forward by the National Development Commission, said that it would fully cooperate with the promotion of "local creation" to promote immigration on the island and urban decompression. 2019 is designated as the "first year of local birth in Taiwan".

With the promotion and implementation of "local creation", rural areas, as the main implementation areas of "local creation", need to have overall planning first, and then carry out spatial planning and resource investment after subject analysis and strategy development, so as to avoid a waste of resources caused by investment that does not meet the demand.

Note 1: "Rural area" is a zoning for the use of non-urban land, which is designated in conjunction with relevant authorities in accordance with Article 11 of the rules for the implementation of the Regional Planning Law and point 5 of the operational instructions, in order to reconcile and improve the rural living and production environment and to meet the needs of the government's policy on the construction of residential communities.
