Southern Rural Daily News: the United States House of Representatives voted to pass the United States 2009 Food Safety Enhancement Act (hereinafter referred to as the "bill") will come into effect at the end of this year. The bill has strict regulations on the registration, fees, third-party certification and testing of food-related enterprises exporting to the United States, as well as mandatory requirements for the establishment of food protection plans, which may have a great impact on the export of aquatic products to the United States.
It is understood that the "Act" mainly strengthens five aspects: first, enterprise registration and fees, requiring enterprises registered with the FDA (US Food and Drug Administration) to pay varying amounts of fees. The registration fee was $500 in 2010 and may be adjusted annually in the future. Second, it has strengthened the inspection of enterprises, and any enterprise products that delay, restrict or reject FDA inspection will be regarded as "adulterated food". Third, it has strengthened the third-party inspection and certification, and FDA has the right to inspect laboratory certification bodies and third-party laboratories. Fourth, risk control has been strengthened, and all registered food enterprises must formulate and implement food protection plans. FDA defines food production and processing enterprises involved in the United States as high-risk enterprises and inspects them at least once every 6-12 months. Fifth, the food recall system has been strengthened, authorizing FDA to withhold and inspect imported food unilaterally without providing any evidence.
The implementation of the Act not only increases the cost of enterprises' exports, but also will be more severely punished if enterprises violate the Act. As long as the FDA has reason to believe that a certain food is adulterated or mislabeled, it can carry out administrative detention of food, and the maximum period of detention will be increased from 30 days to 60 days. The inspection and quarantine department advises all relevant food enterprises exporting to the United States to do a good job in response in advance to ensure smooth export.
