However, some people in the industry said that in addition to legislative support, compulsory food safety liability insurance also requires a certain market premise.

Food liability insurance claims need to prove "ignorance"

It was found that a variety of food labels were incomplete or expired, and ordered it to suspend business for rectification.

That night, the Shanghai Food and Drug Administration seized the Shanghai Husi involved overnight and ordered downstream enterprises to immediately seal up the food raw materials from the company. With the frequent exposure of food safety incidents, food-related "food safety liability insurance" (referred to as "food liability insurance") has once again attracted people's attention.

Whether it is Han Lixuan, Shanghai Husi, or KFC, McDonald's and other catering enterprises, are food-related enterprises, do they all belong to the scope of food liability insurance?

In response, Hao Yansu, dean of the School of Insurance of the Central University of Finance and Economics, said that strictly speaking, Shanghai Husi's products are not directly targeted at consumers, but provide raw materials and sell their products to consumers through businesses such as McDonald's and KFC. Therefore, Shanghai Husi does not belong to the scope of food liability insurance.

However, for the McDonald's, KFC and other companies involved this time, Hao Yansu said that if these companies knew that there was something wrong with Husi's products, they would be "aware of the wrong sales", and the insurance company would be exempt from compensation for the consumer injury caused in this case; if there is evidence to prove that they do not know, then if these enterprises take out food liability insurance and consumers report, the company can get the insurance company to settle the claim. After the insurance company has settled the claim, it can recover the claim from Shanghai Husi.

Food liability insurance "applauded but not popular"

Some developed countries and regions have already legislated to enforce the implementation of food safety insurance. For example, some states in the United States have established a compulsory system of food safety liability insurance through legislation, taking the purchase of insurance as a prerequisite for the production and operation activities of food enterprises. However, food liability insurance in China has always been a voluntary commercial behavior between food enterprises and insurance companies.

In China, more than a dozen Chinese and foreign insurance companies, such as PICC, Pacific Insurance, Allianz and Meiya, have launched a variety of food-related insurance, including food safety liability insurance, food pollution comprehensive insurance and catering industry comprehensive insurance. Among them, PICC property insurance has carried out food product liability insurance business since the 1990s. But the insurance rate is not high. Incomplete statistics show that the insurance rate of liability insurance in China is still less than 1%, and the annual premium income is less than 100 million yuan, and most of the insured are food export enterprises.

As the first professional liability insurance company in China, as of July this year, Changan liability Insurance has opened 12 secondary institutions, all of which have carried out food liability insurance business.
