To this end, there are several issues that must be clarified.
First, it is important to clarify the value right after the separation of the "three rights" of agricultural land. In essence, the value of land is reflected in three aspects: ownership, contract right and management right. Under the premise of collective ownership of agricultural land, farmers' rights and interests are contract right and management right. In fact, the transfer of agricultural land is the right of land management. Therefore, when determining the land transfer price, it can only be determined according to the weight of the land management right. At present, the land transfer behaviors such as "underground transactions" in some rural areas, the so-called "one-off buyout" between farmers and both sides of the transaction are not in line with the policy requirements.
Second, the foothold of policy welfare should be clarified. At present, many policy subsidies come with the right of contracted management of agricultural land. after the separation of the right of contract and the right of management of agricultural land, whether these benefits are subsidized to the right of contract or the right of management must be implemented in specific links according to the requirements of the policy. Such benefits, according to the principle of protecting the interests of farmers, should be determined on the income of the right to contract agricultural land.
Third, the risk obligations under the rights and interests of agricultural land should be clarified. Some localities carry out the construction of irrigation and water conservancy infrastructure and put their responsibilities and obligations on the farmland and mu. Under the premise of the separation of the right of contract and the right of management, whether the responsibility and obligation should be borne by the contractor or the operator, which party owns the assets formed, and how to deal with them once the circulation period expires, these problems should be clearly defined and handled in accordance with the law.
Fourth, the responsibility of farmland protection should be clarified. The transfer of agricultural land can not change the nature of agricultural land, nor can it reduce the original quality.
