Interim provisions of Chongqing Municipality on the Certification and Administration of pollution-free vegetables

Article 1 these interim provisions are formulated in accordance with Article 7 of the measures for the Administration of pollution-free vegetables in Chongqing.

Article 2 the certification of pollution-free vegetables mentioned in these interim provisions refers to the evaluation of the environmental conditions of vegetable production, the quality and safety of vegetable products.

Pollution-free vegetable certification is divided into vegetable base certification and vegetable product certification.

Special marks for pollution-free vegetables can be used in certified pollution-free vegetable bases and pollution-free vegetable products.

Article 3 the special mark for pollution-free vegetables is the certification mark that the vegetable base or vegetable products meet the standards of pollution-free vegetables.

The special logo of pollution-free vegetables is composed of text, graphics and code.

Article 4 the Chongqing Municipal Bureau of Agriculture shall be responsible for the examination, approval, supervision and administration of the certification of pollution-free vegetables throughout the city. The agricultural administrative departments of districts and counties (autonomous counties and cities) shall be responsible for the examination, supervision and administration of the certification of pollution-free vegetables within their respective administrative areas.

Article 5 the certification of pollution-free vegetables shall be applied voluntarily, and all vegetable producers and operators in the administrative area of this Municipality may apply for the certification of pollution-free vegetables.

Article 6 to apply for the certification of pollution-free vegetable base, the following conditions shall be met

(1) the environment of the production base meets the environmental requirements of the producing area of pollution-free vegetables

(2) to organize production in accordance with the technical specifications for the production of pollution-free vegetables

(3) the products meet the quality standards of pollution-free vegetables.

(5) the production scale of commercial vegetables has reached more than 30 hectares.

Article 7 to apply for the certification of pollution-free vegetable products, the following conditions shall be met

(1) the products meet the quality standards of pollution-free vegetables

(2) the production site and environment shall be clean and hygienic, in line with the environmental requirements of pollution-free vegetable producing areas or the provisions of relevant laws and regulations

(3) to have corresponding monitoring means and personnel for pollution-free vegetables, and to establish and improve the quality management system

(4) having a certain production scale and commodity volume.

Article 8 to apply for the certification of pollution-free vegetables, the following materials shall be submitted to the agricultural administrative department of the district or county (autonomous county or city) where they are located:

Application for certification of pollution-free vegetables (in triplicate).

(2) relevant testing reports issued by agricultural environmental monitoring institutions and vegetable quality monitoring institutions with legal qualifications at or above the provincial level; or relevant testing reports issued by other pollution-free vegetable testing institutions certified by relevant municipal departments organized by the Chongqing Municipal Bureau of Agriculture.

The environmental inspection report is valid within three years, and the vegetable product quality inspection report is valid within one year.

(3) quality management system of pollution-free vegetables.

Article 9 the application for certification of pollution-free vegetables shall be handled in accordance with the following procedures:

(1) the agricultural administrative department of the district or county (autonomous county or city) shall, within 15 working days from the date of receiving the application materials, complete the examination of the application materials, sign the examination opinions and submit them to the Municipal Bureau of Agriculture.

(2) the Municipal Bureau of Agriculture shall complete the certification within 30 working days after receiving the audit opinions. Those who meet the requirements shall be issued with the Certificate for the use of Special labels for pollution-free vegetables in Chongqing; if they do not meet the requirements, they shall be returned to the competent agricultural administrative departments of districts and counties (autonomous counties and cities) and notify the applicant in writing.

Article 10 only after the applicant has obtained the Certificate for the use of the Special Mark for pollution-free vegetables in Chongqing can he or she use the special logo for pollution-free vegetables in his products, product packaging, advertisements, signboards or product descriptions.

Article 11 the use of the logo shall only be limited to the vegetable bases and vegetable products approved by the Chongqing Special Mark for pollution-free vegetables, so that the employer may not expand the scope of use of the label at will.

Article 13 products using special marks for pollution-free vegetables must have appropriate packaging, with a certificate of origin, or indicate the origin, manufacturer, product name, production date and other matters on the packaging.

Article 14 the agricultural administrative departments of cities and districts and counties (autonomous counties and cities) shall have the right to supervise and inspect the vegetable bases, products and their production environment and production process where the marks are used, and the relevant personnel shall cooperate.

Article 15 the term of use of special marks for pollution-free vegetables shall be three years. If you need to continue to use the logo, you should re-apply for certification two months before the expiration of the use period. If you fail to reapply for certification, it shall be deemed to be abandoned automatically.

Article 16 under any of the following circumstances, the Certificate for the use of the Special Mark for pollution-free vegetables in Chongqing shall be withdrawn and the use of the special mark for pollution-free vegetables shall be terminated.

(1) failing to carry out production in accordance with the Technical Code for the production of pollution-free vegetables after obtaining the mark

(2) if the product fails to pass the spot check twice within the validity period of the Chongqing Special Mark for pollution-free vegetables

(3) the production environment does not meet the "Environmental Technical conditions for producing areas of pollution-free vegetables"

(4) transferring the special mark of pollution-free vegetables to others without authorization

(5) those used beyond the approved scope of Chongqing Special Mark for pollution-free vegetables

(6) serious consequences caused by a product quality accident

(7) where the user of the logo declares bankruptcy, merger, merger, transfer or renaming.

Article 17 if the conditions for the use of special marks for pollution-free vegetables are temporarily lost due to force majeure, the use of the marks shall be suspended. The resumption of the use of the logo shall be reported to the Municipal Bureau of Agriculture for approval.

Article 18 testing institutions and inspectors shall be responsible for the inspection reports issued, and shall keep the technical secrets of the applicant's products in accordance with the law.

Article 19 the use of special marks for pollution-free vegetables for the production of pesticides, fertilizers, agricultural film and other vegetables shall be carried out with reference to the above-mentioned relevant provisions.

Article 20 the Chongqing Municipal Bureau of Agriculture shall be responsible for the interpretation of these measures.

Article 21 these measures shall enter into force as of April 1, 2002.
