Regulations of Inner Mongolia Autonomous Region on the Administration of Livestock and Poultry

Last Updated: 2024/10/06, CHAPTER I GENERAL PROVISIONS Article 1 In order to strengthen the protection of breed resources of livestock and poultry, breed cultivation and management of breeding stock and poultry, improve the quality of breeding stock and poultry, and promote the industrialization, high yield, high quality and highly efficient development of animal husbandry, the State Council shall, in accordance with relevant laws and regulations and in light of the actual conditions of the Autonomous Region,

Chapter I General principles

Article 1 in order to strengthen the protection of livestock and poultry breed resources, breed cultivation and management of breeding livestock and poultry, improve the quality of breeding livestock and poultry, and promote the industrialization of animal husbandry and the development of high yield, high quality and high efficiency, these regulations are formulated in accordance with relevant laws and regulations and in light of the reality of the autonomous region.

Article 2 the term "breeding livestock and poultry" as mentioned in these regulations refers to livestock and poultry for breeding and their eggs, semen, embryos and other breeding materials.

Article 3 all units and individuals engaged in the protection of livestock and poultry breed resources, breed breeding and the introduction, production, operation, promotion and use of livestock and poultry must abide by these regulations.

Article 4 the development of improved breeds of livestock and poultry should adhere to the combination of cultivation and introduction. People's governments at all levels shall formulate supportive measures and preferential policies to encourage the cultivation, introduction, breeding, promotion and use of improved breeds of livestock and poultry.

Article 5 the administrative departments in charge of animal husbandry at or above the county level shall be in charge of the management of breeding livestock and poultry within their respective administrative areas. Its main duties are:

(1) to implement the relevant laws and regulations on the management of livestock and poultry of the state and autonomous regions

(2) to formulate, organize and implement plans for the protection of livestock and poultry breed resources and the development of breeding livestock and poultry

(3) to supervise and administer the protection of livestock and poultry breed resources, breed cultivation and the introduction, production, operation, promotion and use of breeding livestock and poultry, and to regulate and control the breeding livestock and poultry market

(4) to impose administrative penalties in accordance with the relevant laws and regulations on the management of livestock and poultry of the state and autonomous regions

(5) other duties as prescribed by laws and regulations.

The administrative departments in charge of animal husbandry at or above the county level may entrust the relevant institutions to which they belong to be specifically responsible for the management of breeding livestock and poultry.

Chapter II Protection of Livestock and Poultry breed Resources and examination and approval of Livestock and Poultry breed cultivation

Article 6 people's governments at all levels shall protect livestock and poultry breed resources in accordance with the provisions of the State and autonomous regions, and implement corresponding funds and material conditions for protection.

The list of livestock and poultry breed resources protection at the autonomous region level shall be determined and promulgated by the animal husbandry administrative department of the autonomous region, and livestock and poultry breed records shall be established.

Article 7 the administrative departments in charge of animal husbandry at or above the county level shall conduct regular general surveys, appraisal and monitoring of livestock and poultry breed resources, put forward protection plans and protection measures, and establish and improve the archives management system.

Article 8 the administrative department in charge of animal husbandry in the autonomous region shall establish breeding farms, protected areas, gene banks and dynamic monitoring systems for livestock and poultry breeds in a planned way, and provide special protection for valuable and endangered livestock and poultry breeds.

The administrative departments in charge of animal husbandry at or above the county level may determine that qualified units or individuals shall undertake the task of protecting livestock and poultry breed resources and pay compensation for protection; units and individuals undertaking the task of protecting livestock and poultry breed resources shall carry out protection in accordance with the requirements.

No hybridization of any form shall be carried out without authorization in the livestock and poultry breed resources protection population and the protected area; if it is really necessary, it shall be approved by the animal husbandry administrative department that established the population protection or protection zone.

Article 9 the animal husbandry administrative department of the autonomous region shall be responsible for formulating the regional plan for the improvement of livestock and poultry and the planning of the breeding system of improved livestock and poultry in the autonomous region. The animal husbandry administrative departments of League cities and banner counties shall be responsible for formulating the corresponding plans within their respective administrative areas and shall report them to the animal husbandry administrative departments of the autonomous region for the record.

The animal husbandry administrative departments at or above the county level shall formulate and organize the implementation of livestock breed improvement plans in accordance with the plans prescribed in the preceding paragraph, and establish and improve the breeding system of improved livestock and poultry breeds.

Article 10 the administrative departments in charge of animal husbandry at or above the county level shall, in accordance with the regional plan for the improvement of livestock and poultry and the planning of improved breed breeding system, organize relevant scientific research, teaching and production units to carry out the cultivation of new breeds of livestock and poultry.

Encourage other qualified units and individuals to cultivate new breeds of livestock and poultry.

Article 11 the livestock and poultry breed standards of the autonomous region shall be formulated by the animal husbandry administrative department of the autonomous region and promulgated and implemented after approval by the administrative department of technical supervision of the autonomous region.

Livestock and poultry breeds must be approved and named before they can be promoted. The examination and approval of livestock and poultry breeds in the autonomous region shall be examined and approved by the livestock and poultry breed examination and approval committee of the autonomous region, and submitted to the animal husbandry administrative department of the autonomous region for approval, which shall be named and announced by the people's government of the autonomous region. The specific conditions, procedures and time limit for the examination and approval of livestock and poultry breeds shall be carried out in accordance with the relevant provisions of the administrative departments in charge of animal husbandry of the state and autonomous regions.

The animal husbandry administrative department of the autonomous region shall regularly publish the breeds of livestock and poultry that are encouraged, allowed or restricted.

Chapter III production, Management, Promotion and use of breeding Livestock and Poultry

Article 12 people's governments at all levels shall strengthen the construction of markets for breeding livestock and poultry, develop production bases for breeding livestock and poultry in a planned way, and establish and improve a standardized and orderly purchasing and marketing network.

All qualified units and individuals may engage in the production and operation of livestock and poultry and enjoy the preferential policies prescribed by the state and autonomous regions.

Foreign investors outside the region and abroad are encouraged to engage in the production and operation of livestock and poultry in the form of sole proprietorship, joint venture, cooperation and shareholding system.

Article 13 the establishment of breeding livestock and poultry farms shall be subject to the approval of the animal husbandry administrative department of the autonomous region. The units engaged in the production of frozen semen and embryos shall be designated by the animal husbandry administrative department under the State Council or the animal husbandry administrative department of the autonomous region.

Article 14 Livestock and poultry farms shall undertake the tasks of protecting livestock and poultry breed resources, cultivating and breeding new varieties, providing high-quality breeding livestock and poultry, and popularizing and demonstrating advanced science and technology.

The original seed farm is responsible for breeding and providing the original breed of livestock and poultry, while the improved breed breeding farm is responsible for the expansion and promotion of improved breeds of livestock and poultry.

Article 15 the original seed farm must meet the following conditions:

(1) the establishment of livestock and poultry breeds is in line with the regional planning of livestock and poultry improvement and the planning of improved breed breeding system in the autonomous region.

(2) having the necessary infrastructure and technical equipment for breeding livestock and poultry production, special breeding sites, complete introduction and breeding records and clear breeding objectives, the number of breeding livestock and poultry reaches the prescribed scale, and the quality of the basic group meets the breed standards.

(3) there are scientific and advanced breeding and feeding techniques, sound production management system and complete test records of reproduction and production performance, etc.

(4) to have a sound veterinary health system, facilities and environmental health protection measures

(5) there are a certain number of professional and technical personnel who are competent for the breeding of the original species.

(6) to be able to produce healthy and qualified breeding livestock and poultry and have a certain ability to supply breeding.

Frozen semen station and embryo transfer center shall be carried out with reference to the above conditions.

Article 16 the establishment of a breeding farm for improved varieties must meet the following conditions:

(1) the establishment of livestock and poultry breeds is in line with the regional planning of livestock and poultry improvement and the planning of improved breed breeding system.

(2) the quality of livestock and poultry meets the breed standards, and the pedigree is clear.

(3) having the infrastructure and conditions to meet the production of breeding livestock and poultry

(4) have corresponding professional and technical personnel

(5) the sanitary conditions of veterinarians are qualified.

Article 17 Units and individuals that are solely engaged in breeding livestock and poultry operation and egg hatching must meet the following requirements:

(1) the establishment of livestock and poultry breeds is in line with the regional planning of livestock and poultry improvement and the planning of improved breed breeding system.

(2) the quality of breeder and hatchling meets the breed standard

(3) having the corresponding infrastructure and conditions

(4) the employees are qualified through professional and technical training.

(5) the sanitary conditions of veterinarians are qualified.

Article 18 State-owned livestock and poultry farms shall serve the improvement of livestock and poultry as the fundamental purpose, adhere to the combination of production, management and service, and play an exemplary and leading role in the industrialized operation of animal husbandry.

Article 19 all units and individuals engaged in the production and operation of breeding livestock and poultry must obtain the license for production and operation of breeding livestock and poultry and register with the local administrative department for industry and commerce on the strength of the license. If the production or operation of breeding livestock and poultry needs to be changed or terminated, the producers and operators must go through the corresponding formalities with the original license issuing and registration departments.

Article 20 Frozen semen stations, embryo transfer centers, original seed farms and improved breed breeding farms shall be issued with a "license for production and Operation of breeding Livestock and Poultry" after passing the examination and acceptance by the animal husbandry administrative department of the autonomous region. The animal husbandry administrative department of the autonomous region may entrust the League and municipal animal husbandry administrative departments to check and accept the improved seed breeding grounds. Units and individuals simply engaged in breeding livestock and poultry operation and egg hatching shall be issued with a "production and Operation license for breeding Livestock and Poultry" after passing the acceptance check by the animal husbandry administrative department at or above the county level.

The administrative department in charge of animal husbandry shall, within one month from the date of receiving the application for the license for production and Operation of breeding Livestock and Poultry, make a decision on whether to issue the license or not. For units and individuals that have obtained the license for production and Operation of breeding Livestock and Poultry, the license issuing department shall conduct random inspection from time to time.

Article 21 breeding livestock and poultry that are produced, operated, popularized and used must meet the quality standards.

The supervision and administration agencies for breeding livestock and poultry set up by the administrative departments in charge of animal husbandry at or above the county level shall be responsible for the inspection of the quality of breeding livestock and poultry, register the qualified breeding livestock and poultry, and issue the certificate of qualification for breeding livestock and poultry.

Article 22 the breeder livestock and poultry sold must be accompanied by the "breeder livestock and poultry qualification certificate" signed by the breeding livestock and poultry supervision and administration institution or personnel, the breeding livestock pedigree, and the "breeder livestock and poultry health certificate" issued by the veterinary quarantine institution.

Article 23 advertisements for breeding livestock and poultry must be examined and approved by the local animal husbandry administrative department before publication; they shall not be published without examination and approval. In order to apply for the examination of the advertisement of breeding livestock and poultry, you must hold the production and Operation license of breeding Livestock and Poultry and provide the relevant materials of breeding livestock and poultry.

Article 24 the annual inspection system and elimination system shall be implemented for breeding livestock and poultry. Livestock and poultry that have not been tested and identified or that are unqualified shall not be used for breeding. For breeding male livestock that do not meet the breed standards, the local breeding livestock and poultry supervision and administration agency may decide to forcibly castrate.

Article 25 people's governments at all levels shall establish and improve the service system for the promotion of improved breeds of livestock and poultry, stabilize the ranks, increase investment, improve service facilities and means, and popularize fine breeds of livestock and poultry, as well as advanced and practical technologies such as artificial insemination and embryo transfer, speed up the pace of breed improvement and improve the quality of livestock and poultry breeds.

The technical popularization institutions of animal husbandry at all levels shall be responsible for providing technical guidance and training to units and individuals that produce, operate and use breeding livestock and poultry.

Article 26 artificial insemination shall be carried out for local livestock with technical and material conditions for breeding.

Personnel engaged in artificial insemination of livestock must receive professional and technical training, be examined by the administrative department in charge of animal husbandry at or above the county level and obtain a certificate of qualification before they can engage in artificial insemination of livestock.

Article 27 the import and export of breeding livestock and poultry to the autonomous region shall be submitted to the animal husbandry administrative department of the autonomous region for approval; the import and export of breeding livestock and poultry between cities, banners and counties within the autonomous region shall be submitted to the animal husbandry administrative department at the same level for approval. After receiving the application for the import and export of breeding livestock and poultry, the administrative department in charge of animal husbandry shall examine and approve it in a timely manner. The imported and exported breeding livestock and poultry must be accompanied by the "breeding Livestock and Poultry Certificate", the breeding Animal pedigree and the "breeding Livestock and Poultry Health Certificate".

Article 28 the import and export of breeding livestock and poultry must fill in the examination and approval form for Import and Export breeding Livestock and Poultry, which shall be examined by the animal husbandry administrative department of the autonomous region and submitted to the animal husbandry administrative department under the State Council for approval, and shall go through quarantine and other relevant formalities in accordance with the law.

Article 29 Units that undertake the transportation of breeding livestock and poultry in areas above the county level must present the permit Transport Certificate and the Health Certificate of breeding Animal Husbandry issued by the administrative department in charge of animal husbandry at or above the county level before they can undertake the transportation.

The unit that undertakes the transportation of import and export breeding livestock and poultry must rely on the approved examination and approval form of Import and Export breeding Livestock and Poultry issued by the consignment unit and the Health Certificate of breeding Animal and Poultry issued by the port animal quarantine organ.

Chapter IV legal liability

Article 30 whoever commits any of the following acts shall be ordered by the administrative department in charge of animal husbandry at or above the county level to make corrections, confiscate the illegal gains and impose a fine of one to two times the illegal gains:

(1) producing or operating breeding livestock and poultry without obtaining the license for production and Operation of breeding Livestock and Poultry

(2) failing to produce or manage breeding livestock and poultry in accordance with the prescribed breeds, strains, generations, utilization life and quality standards

(3) popularizing unapproved and named breeds of livestock and poultry

(4) the sale of breeding livestock and poultry is not accompanied by the Certificate of breeding Livestock and Poultry, the pedigree of breeding Livestock and the Health Certificate of breeding Livestock and Poultry.

If one of the acts mentioned in subparagraphs (2) and (4) of the preceding paragraph is committed, and the circumstances are serious, the license for production and Operation of breeding Livestock and Poultry may be revoked.

Article 31 the sale of breeding livestock and poultry that do not meet the quality standards shall be substandard and fake as genuine, and shall be punished in accordance with the relevant provisions of the Law of the people's Republic of China on Product quality and the Law of the people's Republic of China on the Protection of consumers' Rights and interests; if economic losses are caused to a unit or individual, he shall bear the corresponding civil liability for compensation.

Those who publish advertisements for breeding livestock and poultry without examination and approval shall be punished by the administrative departments for industry and commerce at or above the county level in accordance with relevant laws and regulations.

Article 32 whoever refuses or hinders the managers of breeding livestock and poultry from performing their official duties according to law shall be punished by the public security organ in accordance with the regulations of the people's Republic of China on Administrative penalties for Public Security; if the circumstances are serious enough to constitute a crime, they shall be investigated for criminal responsibility according to law.

Article 33 if a party is not satisfied with an administrative penalty, he may apply for administrative reconsideration or bring a lawsuit according to law. If it fails to apply for administrative reconsideration, file a lawsuit or comply with the penalty decision within the time limit, the organ that made the penalty decision may apply to the people's court for compulsory enforcement.

Article 34 any manager of livestock and poultry who abuses his power, neglects his duty or engages in malpractices for personal gain shall be given administrative sanctions according to law; if the case constitutes a crime, he shall be investigated for criminal responsibility according to law.

Chapter V Supplementary provisions

Article 35 these regulations shall enter into force as of the date of promulgation.
