Measures for the Administration of licenses for the production and Operation of crop Seeds

Chapter I General provisions

Article 1 these measures are formulated in accordance with the seed Law of the people's Republic of China in order to strengthen the license management of crop seed production and management and standardize the order of crop seed production and management.

Article 2 these measures shall apply to the application, examination, issuance and supervision of crop seed production and management licenses.

Article 3 the agricultural administrative departments of the people's governments at or above the county level shall, in accordance with the division of duties, be responsible for the acceptance, examination, issuance and supervision of crop seed production and operation licenses.

Article 4 the competent agricultural administrative department responsible for examining and issuing crop seed production and operation licenses shall publicize the conditions and procedures for handling crop seed production and operation licenses at the office.

Article 5 the competent department of agricultural administration shall issue licenses for the production and operation of crop seeds in accordance with the law in accordance with the principles conducive to ensuring the safety of agricultural production, improving the breeding and production level of crop varieties and promoting fair competition.

Chapter II production license

Article 6 whoever produces commercial seeds of major crops shall obtain a seed production license for major crops (hereinafter referred to as seed production license) in accordance with the law.

The production licenses for hybrid seeds of major crops and their parent seeds and conventional original seeds shall be examined and approved by the agricultural administrative departments of the people's governments at the county level where they are produced, and issued by the competent agricultural administrative departments of the people's governments at the provincial level. The seed production licenses of other major crops shall be issued by the competent department of agricultural administration of the local people's government at or above the county level where the production is located.

If the producer applies for a seed production license if the production location is a non-major crop and it is a major crop in other provinces (autonomous regions or municipalities directly under the Central Government), the agricultural administrative department in the place where it is produced shall accept it and issue it according to law.

Article 7 to apply for a seed production license, the following conditions shall be met:

(1) for those who apply for hybrid rice, hybrid corn seeds and their parent seed production licenses, the registered capital shall be not less than 30 million yuan; for those who apply for seed production licenses for other major crops, the registered capital shall be not less than 5 million yuan.

(2) the variety produced has passed the variety examination and approval; the written consent of the variety owner shall also be obtained for the production of seeds with the right of new plant varieties.

(3) more than 1 set of cleanliness analysis table, electronic scale, bed setting equipment, electrophoresis apparatus, electrophoresis tank, sample grinder, oven, biological microscope and refrigerator, and more than 1 set of electronic balance (sensitivity 1%, 1/1000 and 1/10000). More than 2 sets of sampler, sampler and germination box Those who apply for the production license of hybrid rice and hybrid corn seeds shall also be equipped with more than one pcr expander, acidity meter, high pressure sterilizer, magnetic mixer, constant temperature water bath pot, high speed freezing centrifuge and complete set of liquid transfer equipment.

(4) the inspection room is more than 100 square meters; if you apply for the seed production license of hybrid rice, hybrid corn and their parents, the inspection room shall be more than 150 square meters.

(5) having a warehouse of more than 500m2 and a drying field of more than 1000 sq m or corresponding seed drying facilities

(6) there are more than 3 full-time seed production technicians, storage technicians and seed inspection personnel (including field inspection, cutting sample and indoor inspection, the same below) who are qualified by the agricultural administrative departments of the people's government at or above the provincial level. Among them, there are more than 5 seed production technicians and seed inspection personnel for the production of hybrid rice, hybrid corn seeds and their parents.

(7) there are no quarantine pests at the place of production

(8) isolation and production conditions that meet the requirements of seed production regulations

(9) other conditions prescribed by the Ministry of Agriculture.

Article 8 when applying for a seed production license, the following materials shall be submitted:

(1) Application form for seed production license

(2) photocopies of registered capital certificates such as annual accounting statements and intermediary audit reports within one year prior to the date of application; photocopies of seed inspection equipment lists and purchase invoices; photocopies of property rights certificates in seed inspection rooms and warehouses in the provinces (autonomous regions and municipalities directly under the Central Government) where they are located. A copy of the property right certificate (or lease agreement) of the drying field in the province (autonomous region or municipality directly under the Central Government) where the production is located, or a copy of the property right certificate of the seed drying facilities and equipment; a copy of the verification certificate of the inspection equipment related to measurement issued by the metrological verification institution; the description of the relevant facilities and equipment and the actual scene photos

(3) qualification certificates of technical personnel and copies of labor contracts for seed production, storage and inspection.

(4) Quarantine certificate at the place of seed production

(5) A copy of the variety approval certificate

(6) to produce seeds with the right of a new plant variety and submit a written consent certificate of the owner of the variety

(7) Safety isolation and description of production conditions for seed production

(8) other materials prescribed by the Ministry of Agriculture.

If an applicant for a seed production license has obtained a seed operation license for the corresponding crop, he shall be exempted from submitting the certificate of qualification of the technical personnel and the copy of the labor contract for the storage and inspection of the materials and seeds specified in paragraph 2 of the preceding paragraph, however, a copy of the seed operation license shall be submitted.

Article 9 the examination and approval organ shall complete the examination within 20 working days from the date of accepting the application. During the examination, the production site, drying site or drying facilities, storage facilities, inspection facilities and equipment shall be inspected on the spot and the original supporting materials shall be examined (only the production site shall be inspected for those with the corresponding crop seed management license). If the conditions prescribed in these measures are met, the examination opinions shall be signed and reported to the examination and issuing authority; if the examination is not passed, the applicant shall be notified in writing and the reasons shall be given.

The issuing authority shall complete the verification and distribution within 20 working days from the date of receipt of the examination opinions and application materials. If the issuing authority deems it necessary, it may conduct an on-the-spot investigation. If the conditions are met, a seed production license shall be issued and a public announcement shall be made; if the conditions are not met, the applicant shall be notified in writing and the reasons shall be given.

Article 10 the seed production license shall indicate the license number, the name of the enterprise, the domicile, the legal representative, the registered capital, the license issuing authority, the document number of the announcement, the time of issuing the license, as well as the crop type, variety name, examination and approval number, new plant variety right number, production place, term of validity and other items for seed production.

The license number is "_ _ (x) agricultural seed permit word (x) No. X". Among them, the first bracket is the abbreviation of the license issuing authority, and the second bracket is the year number of the first issue. the third number is a four-digit sequence number; the type of seed produced is marked on "_": B is hybrid rice and hybrid corn seeds and their parent seeds, and c is the seeds of other major crops.

Article 11 the seed production license shall be valid for 3 years. If the same enterprise applies to the same examination and issuance authority to increase the production of similar crop varieties within the period of validity of the production license, the examination and issuance authority shall add the corresponding varieties to the original license and shall no longer issue a separate production license.

If a seed producer needs to apply for a new license at the same examination and issuing authority after the expiration of the seed production license, he shall re-apply for it 70 days before the expiration of the license.

Chapter III Business license

Article 12 whoever deals in crop seeds shall obtain a license for crop seed management (hereinafter referred to as seed management license) in accordance with the law.

The license for the operation of hybrid seeds of major crops and their parents and conventional original seeds shall be examined and approved by the competent agricultural administrative department of the people's government at the county level where the seed operator is located, and issued by the competent agricultural administrative department of the people's government at the provincial level.

The following seed operation licenses shall be examined and approved by the agricultural administrative department of the people's government at the provincial level where the seed operator is located, and issued by the Ministry of Agriculture:

(1) seed operation license of a company engaged in seed import and export business

(2) to implement the seed operation license of a company with a registered capital of more than 100 million yuan with the combination of breeding, production and operation.

The license for seed operation of other crops shall be issued by the competent department of agricultural administration of the local people's government at or above the county level where the seed operator is located.

Article 13 to apply for a license for seed management of hybrid rice, hybrid corn and their parents, the following conditions shall be met:

(1) not less than 30 million yuan in registered capital and not less than 10 million yuan in fixed assets

(2) it has more than 1 set of cleanliness analysis table, electronic scale, bed equipment, electrophoresis apparatus, electrophoresis tank, sample grinder, oven, biological microscope and refrigerator, and more than 1 set of electronic balance (sensitivity 1%, 1/1000 and 1/10000). More than 2 sets of sampler, sampler and germination box More than 1 set of pcr expander, acidity meter, high pressure sterilizer, magnetic agitator, constant temperature water bath pot, high speed freezing centrifuge and complete set of liquid transfer The laboratory is more than 150 square meters

(3) having seed warehouses, drying grounds or corresponding drying facilities and equipment that meet the requirements of paragraph 5 of Article 7 of these measures, and more than 300 square meters of business premises

(4) complete sets of equipment for seed processing, with a total processing capacity of not less than 10 tons per hour for hybrid corn seeds, no less than 5 tons per hour for hybrid rice seeds, and more than 500 square meters of processing plant.

(5) there are more than 5 full-time seed processing technicians, more than 3 seed storage technicians, and more than 5 qualified seed inspection personnel who have been assessed by the agricultural administrative departments of the people's governments at or above the provincial level.

(6) other conditions prescribed by the Ministry of Agriculture.

Article 14 to apply for a license for the operation of crop seeds other than hybrid rice, hybrid corn seeds and their parents, which should be processed and packaged, the following conditions shall be met:

(1) those who apply for major crop seed management licenses shall have a registered capital of not less than 5 million yuan and fixed assets of not less than 2.5 million yuan, and those who apply for seed management licenses of non-major crops shall have a registered capital of not less than 2 million yuan and fixed assets of not less than 1 million yuan.

(2) it has more than 1 set of cleanliness analysis table, electronic scale, bed setting equipment, electrophoresis apparatus, electrophoresis tank, sample grinder, oven, biological microscope and refrigerator, and more than 1 set of electronic balance (sensitivity 1%, 1/1000 and 1/10000). More than 2 sets of samplers, samplers and germination boxes, and more than 100 square meters of testing room

(3) those dealing in the seeds of major crops shall have seed warehouses, drying grounds or corresponding drying facilities and equipment that meet the requirements of paragraph 5 of Article 7 of these measures, with business premises of more than 200 square meters; those dealing in seeds of non-major crops, there are warehouses of more than 300 square meters, drying fields of more than 500 square meters or corresponding drying facilities and equipment, and business premises of more than 200 square meters.

(4) for those dealing in conventional rice or wheat seeds, the total processing capacity of complete sets of seed processing equipment is more than 10 tons per hour; for those dealing in soybean seeds, the total processing capacity of complete sets of seed processing equipment is more than 3 tons per hour; for those dealing in cotton and rape seeds, the total processing capacity of complete sets of seed processing equipment is more than 1 ton / hour; those dealing in other crop seeds shall have corresponding seed processing equipment.

(5) for those dealing in major crop seeds, the seed processing plant shall be more than 500 square meters; for those dealing in non-major crop seeds, the seed processing plant shall be more than 200 square meters.

(6) there are three or more full-time seed processing technicians, storage technicians and seed inspection personnel who have passed the examination by the competent department of agricultural administration of the people's government at or above the provincial level.

For those who apply for the license for the operation of crop seeds without processing or packaging prescribed by the Ministry of Agriculture, their registered capital and fixed assets shall comply with the provisions of paragraph 1 of the preceding paragraph, the specific requirements for equipment and personnel for seed inspection and storage facilities shall be prescribed by the agricultural administrative department of the people's government at the provincial level and reported to the Ministry of Agriculture for the record.

Article 15 A company engaged in seed import and export business shall meet the following requirements when applying for a seed business license:

(1) not less than 30 million yuan in registered capital and not less than 10 million yuan in fixed assets

(2) other conditions for the issuance of corresponding crop seed management licenses as stipulated in these measures.

Article 16 A company that combines breeding, production and operation with a registered capital of more than 100 million yuan shall meet the following requirements for applying for a seed operation license:

(1) fixed assets of not less than 50 million yuan

(2) it has more than 2 sets of cleanliness analysis table, electronic scale, bed setting equipment, electrophoresis apparatus, electrophoresis tank, sample grinder, oven, biological microscope and refrigerator, and more than 2 sets of electronic balance (sensitivity 1%, 1/1000 and 1/10000). More than 3 sets of sampler, sampler and germination box More than 2 sets of pcr amplifiers, acidity meters, high pressure sterilizers, magnetic agitators, constant temperature water baths, high speed freezing centrifuges and complete sets of liquid transfer machines The laboratory is over 200 square meters.

(3) those who apply for the operation of major crop seeds shall have warehouses of more than 1500 square meters, drying fields of more than 3000 square meters or corresponding seed drying facilities and equipment, and business premises of more than 3000 square meters; those who apply for the management of seeds of non-major crops shall have warehouses of more than 300square meters, drying fields of more than 500square meters or corresponding seed drying facilities and equipment, and business premises of more than 300square meters.

(4) those who apply for the management of hybrid rice and hybrid maize seeds and their parent seeds shall be equipped with seed drying facilities commensurate with their seed management scale, the total processing capacity of hybrid rice seeds and their parents seed processing equipment is more than 10 tons / hour, the total processing capacity of hybrid corn seeds and their parents seed processing equipment is more than 20 tons / hour, and the processing plant is more than 800 square meters. For those who apply for the management of other crop seeds, the processing capacity and the processing plant shall meet the corresponding requirements of item 4 and 5 of Article 14 of these measures.

(5) there are five or more full-time seed production, processing and storage technicians and five or more seed inspection personnel who have been assessed by the agricultural administrative departments of the people's governments at or above the provincial level.

(6) there are specialized breeding institutions, fixed breeding personnel and working funds, and the annual investment in scientific research shall not be less than 10% of the annual profit; it has its own scientific research laboratory of more than 300 square meters and stable breeding land of more than 100 mu, of which, there are more than 3 test sites in each of the more than 3 different ecological regions throughout the country, each with more than 10 mu of experimental land and corresponding sowing, harvesting and seed testing facilities and equipment. There are more than 5 researchers with intermediate or above professional titles full-time engaged in scientific research and breeding (or bachelor's degree or above in related majors); those who produce and manage the seeds of major crops, each crop shall also have a full-time senior title for scientific research and breeding (or a master's degree or above in related majors) more than 1 researcher

(7) there is a stable seed production base. Among them, those who deal in the seeds of major crops shall have a base of more than 5000 mu, and those who deal in other crop seeds shall have a base of more than 500mu.

(8) have a sound after-sales service system

(9) for those who apply for the management of major crop seeds, there are more than two varieties separately applied for in the name of the applicant enterprise and approved at the national level, or more than five varieties separately applied in the name of the applicant enterprise and approved at the provincial level in at least three provinces (autonomous regions and municipalities directly under the Central Government); for those who apply for the management of non-major crop seeds, there are more than five varieties that have obtained the right of new plant varieties in the name of the applicant enterprise alone.

(10) within 3 years before the date of application (excluding the year in which the application is made), the seed market share of this kind of crops in the country accounts for more than 1% for more than one year. The operating volume of independent intellectual property varieties accounts for more than 10% of the company's total business volume.

(11) other conditions prescribed by the Ministry of Agriculture.

Article 17 when applying for a seed business license, the following materials shall be submitted:

(1) Application form for crop seed management license

(2) photocopies of registered capital and fixed assets certificates such as the annual accounting statements and intermediary audit reports within one year prior to the date of the application; and the basic certification materials such as the nature and capital composition of the applicant

(3) A copy of the list of facilities and equipment for seed inspection and processing and a copy of the purchase invoice; a copy of the property right certificate of the seed inspection room, processing plant and warehouse; a copy of the property right certificate (or lease agreement) of the drying field, or a copy of the property right certificate of seed drying facilities and equipment; a copy of the verification certificate of inspection and packaging equipment related to measurement issued by the metrological verification institution Description of relevant facilities and equipment and real-life photos

(4) qualification certificates and copies of labor contracts of technical personnel related to seed inspection, processing, storage, etc.

(5) other materials prescribed by the Ministry of Agriculture.

Article 18 if a company that combines breeding, production and management applies for a license for crop seed management issued by the Ministry of Agriculture, it shall submit the following materials in addition to the materials specified in Article 17:

(1) description of breeding institutions; photocopies of self-owned property rights certificates and actual photos of scientific research and breeding facilities and equipment; photocopies of the agreement on the transfer of scientific research, breeding and variety test land for more than 5 years

(2) the certification materials of the professional title (or educational background) of the breeder and a copy of the labor contract

(3) A copy of the annual accounting statements and intermediary audit reports of the three years prior to the date of application

(4) A photocopy of the variety approval certificate or the new plant variety right certificate, which has the proof of the independent production and management right of the variety; the description and relevant certificates of the seed management volume, business volume and national market share of the licensed crops in the three years prior to the date of application; the seed business volume and business volume of independent intellectual property varieties and related certificates

(5) the certification materials of the seed production base in the three years prior to the date of application, including the place of seed production (specific to the village), the area of seed production, the telephone list of the contact person of the base village (group) and the entrusted seed producer, and 10 copies of the seed production contract, or a copy of the land transfer agreement

(6) supporting materials for a sound after-sales service system, including the after-sales service system and the construction of the after-sales service network, etc.

(7) if a new application is made before the expiration of the period of validity, the certification materials of seed production, operation, scientific research and breeding within the validity period of the original seed business license shall also be provided.

Article 19 the examination and approval organ shall complete the examination within 20 working days from the date of accepting the application. The examination and approval organ shall conduct an on-the-spot inspection of the business premises, processing and storage facilities, inspection facilities and equipment and examine the original supporting materials. If the conditions prescribed in these measures are met, the examination opinions shall be signed and reported to the examination and issuing authority; if the examination is not passed, the applicant shall be notified in writing and the reasons shall be given.

The examination and issuing authority shall complete the examination and distribution within 20 working days from the date of receipt of the application materials and examination opinions. If the issuing authority deems it necessary, it may conduct an on-the-spot investigation. If the conditions are met, a seed business license shall be issued and a public announcement shall be made; if the conditions are not met, the applicant shall be notified in writing and the reasons shall be given.

Article 20 the license for seed operation shall indicate the license number, enterprise name, domicile, legal representative, registered capital, license issuing authority, document number of announcement, date of issuance, as well as the scope of crop operation, mode of operation, effective area, term of validity and other items:

(1) the license number is "_ _ (x) Agricultural seed permit word (x) No. X", the first bracket is the abbreviation of the license issuing authority, the second bracket is the year number of the first license issue, and the third number is a four-digit serial number; "_" marks the management type: an is issued by the Ministry of Agriculture and carries out the combination of breeding, production and management; b the seeds of hybrid rice and hybrid corn and their parents C for main crop seeds other than hybrid rice and hybrid corn; d for non-major crop seeds; e for seed import and export business

(2) the scope of operating crops, the names of major crops and the categories of vegetables, flowers, hemp and other crops for non-major crops

(3) seed operation mode, including processing, packaging, wholesale, retail or import and export

(4) the effective area shall be filled in according to the administrative area, and the maximum shall not exceed the jurisdiction of the issuing organ, which shall be decided by the issuing authority.

Article 21 the seed trading license shall be valid for 5 years. If the items marked in the license are changed within the period of validity, the change procedures shall be handled in accordance with the original application procedures, and the corresponding supporting materials shall be provided.

If a seed operator continues to engage in seed management after the expiration of the business license, the seed operator shall apply again six months before the expiration of the period.

Article 22 where a seed operator specializes in packaged seeds that are no longer sub-packaged, or is entrusted in writing by a seed operator with a seed business license to sell his seeds, he may not apply for a seed business license, but there shall be a fixed place of business.

Those who specialize in packaged seeds that are no longer sub-packaged shall sign a purchase and sales contract with a seed enterprise with a seed management license when purchasing the seeds.

If a seed operator with a seed business license entrusts him to sell his seeds on a consignment basis, he shall sign an entrustment contract with the consignor.

Article 23 where a seed operator sets up a branch in a valid area specified in the business license, it shall register for industry and commerce with the administrative department for industry and commerce, and within 15 days after obtaining or changing the business license, report to the agricultural administrative department of the local people's government at the county level and the original license-issuing authority for the record. A copy of the seed operation license and business license, as well as the domicile, mode of operation, name of the person in charge, contact number and other materials of the branch shall be submitted for the record.

Chapter IV Supervision and Administration

Article 24 seed producers of major crops shall organize seed production in accordance with the provisions of the seed production license. Seed producers shall establish seed production files and, within 30 days after sowing, report the production location, variety name, production area and other information to the competent agricultural administrative department of the people's government at the county level where the production is located. The agricultural administrative department of the people's government at the county level shall summarize the production information and report it to the Ministry of Agriculture step by step.

Article 25 seed operators shall establish seed management files, which shall contain a brief description of the source, processing, storage, transportation and quality inspection of seeds, as well as the persons responsible and the whereabouts of sales.

The seed trading enterprise shall report the main business activities of the previous year to the license issuing authority before the end of May of each year. The license issuing authority shall summarize the seed management information and report it to the Ministry of Agriculture.

Article 26 the competent agricultural administrative departments of the people's governments at or above the county level shall supervise and inspect the seed production and the seed production and operation of business operators.

Article 27 in any of the following circumstances during the period of validity of the license, the license issuing authority shall cancel the license and make a public announcement:

(1) where seed production or business operators stop their production or business activities for more than one year

(2) seed production and business operators no longer meet the licensing conditions stipulated in these measures and fail to meet the requirements after rectification and reform within a time limit.

Article 28 where an applicant conceals the relevant information or provides false materials to apply for a license for seed production or operation, the competent administrative department of agriculture shall not grant permission and notify the relevant situation. The applicant shall not apply for seed production or operation license again within one year.

If the applicant obtains the license for seed production or operation by deception, bribery or other improper means, the competent administrative department of agriculture shall revoke the administrative license and notify the relevant situation. The applicant shall not apply for seed production or operation license again within 3 years.

Article 29 the agricultural administrative department at a higher level shall supervise and inspect the seed production and operation license of the agricultural administrative department at the lower level. Under any of the following circumstances, it shall be ordered to make corrections, and the persons directly in charge and other persons directly responsible shall be given administrative sanctions according to law; if the case constitutes a crime, it shall be transferred to the judicial organ for criminal responsibility according to law:

(1) failing to issue licenses for seed production and operation in accordance with the authority for approval

(2) lowering the standards for issuance and issuing licenses for seed production and operation without authorization

(3) others who fail to issue licenses for seed production and operation according to law.

Article 30 where the competent department of agricultural administration revokes, revokes or cancels the seed production or operation license of the offender according to law, it shall notify the administrative department for industry and commerce to cancel or change the business license according to law within 5 working days after the decision is made.

Article 31 the competent administrative department of agriculture shall establish an online inquiry system for the management of seed production and business license and publish the relevant license information, except those that need to be kept confidential according to law.

The competent agricultural administrative department and its staff shall keep confidential the commercial secrets of seed producers and operators that have been learned in the course of management.

Chapter V Supplementary provisions

Article 32 the term "seed production" as mentioned in these measures refers to the activities of planting, collecting, drying or drying seeds.

The term "seed management" as mentioned in these measures refers to the activities of cleaning, grading, drying, coating and other processing of the produced seeds, as well as packaging, marking and sales.

Article 33 the term "complete sets of seed processing equipment" as mentioned in these measures refers to a seed processing system in which the mainframe and supporting systems match each other and are fixedly installed in the processing plant to realize the functions of seed selection, metering and packaging. The main engine mainly includes air screen cleaning machine (the air separation part should have front and rear suction duct, double settling chamber; the screening part should have more than three layers of sieve), gravity cleaning machine and computer metering and packaging coding equipment; the supporting system mainly includes transportation system, storage system, dust removal system, impurity removal system and electric control system. The complete set of equipment for processing hybrid rice seeds also includes a socket cleaning machine which can complete the length cleaning operation.

The term "fixed assets" as mentioned in these measures refers to non-monetary assets held by enterprises for the production of products, the provision of labor services, leasing or operation and management, which have been used for more than 12 months, including houses, buildings, machinery, machinery, means of transport and other equipment, appliances and tools related to production and business activities.

Article 34 the personnel engaged in scientific research, production, processing, inspection and storage of seeds as stipulated in these measures shall sign labor contracts with their enterprises for more than 3 years.

The seed production, processing and testing facilities and equipment, as well as seed inspection rooms, warehouses, seed drying facilities and processing plants prescribed in these measures shall be owned by the applicant enterprise.

Article 35 the provisions on the license for the production and management of seeds of genetically modified crops shall be formulated separately by the Ministry of Agriculture.

Article 36 for districts (counties and cities) that do not have competent agricultural administrative departments, the licenses for seed production and operation shall be examined and approved by the competent agricultural administrative departments of the people's governments at the prefectural (city) level.

Article 37 the licenses for the production and operation of crop seeds shall be uniformly printed by the Ministry of Agriculture, and the relevant form format shall be uniformly formulated by the Ministry of Agriculture.

Article 38 these measures shall enter into force as of September 25, 2011. The measures for the Administration of crop seed production and Operation licenses issued by the Ministry of Agriculture on February 26, 2001 and revised on July 1, 2004 (decree No. 48 of the Ministry of Agriculture) shall be repealed at the same time. If the provisions on the license for seed production and operation issued by the Ministry of Agriculture before the implementation of these measures are inconsistent with these measures, these measures shall apply.

For an enterprise that has obtained a crop seed production license before the date of implementation of these measures and is valid from the date of implementation of these measures to April 1, 2012, the validity period of its seed production license shall be automatically extended to April 1, 2012. For an enterprise that has obtained a crop seed business license and is valid from the date of implementation of these measures to September 25, 2012, the validity period of its seed business license shall be automatically extended to September 25, 2012.
