The continuous closure of wholesale markets after the Spring Festival has led to fluctuations in vegetable prices. the Council of Agriculture released a review report yesterday (9) saying that agricultural products wholesale markets should not be closed for three consecutive days except the Lunar New year. The Legislative Yuan's legal Bureau wrote an article entitled "Research on the collapse of vegetable prices caused by the closure of Wholesale Markets," arguing that the stable climate and the 11-day closure of some wholesale markets within a short period of 20 days have resulted in a sharp increase in vegetable supply, a drop in prices, and great losses for vegetable farmers.

The Legislative Yuan legal Bureau pointed out that although the types of agricultural products are different in different places, and the operation of each wholesale market needs to be adapted to local conditions, when there is an imbalance between production and marketing, in order to stabilize the supply of agricultural products, it is necessary for the central competent authority to intervene in the operation of the wholesale market in a timely manner. It is suggested that the Agricultural products Market Trading Law can refer to the legislative intent of Article 23 (1) of the Animal Husbandry Law and add the central competent authority to stabilize production and marketing. Implement relevant adjustment measures for the wholesale market when necessary.

The full text of the Legislative Yuan Legislative Bureau's "Research and Analysis on the collapse of vegetable prices caused by the closure of Wholesale Market" is as follows:

(1) the stable climate and the 11-day closure of some wholesale markets in a short period of time have led to a sharp increase in vegetable supply and a drop in prices, resulting in great losses for vegetable farmers.

During the Spring Festival, the period of vegetable production is shortened because of the stable climate. What's more, due to the warming of the climate, the first phase of rice cultivation rushed to transplant seedlings, so farmers rushed to harvest vegetables to plant rice immediately. under the above-mentioned double factors, the supply of vegetables increased greatly, but at the same time, Taipei Agricultural Transportation and Marketing Company, Triple Fruit and vegetable Transportation and Marketing Company, New Taipei City and other metropolitan fruit and vegetable wholesale markets were closed for 5 days during the Spring Festival, and the market was closed again for 3 days since February 24. By this time, due to the imbalance between supply and demand and falling prices due to the rush to harvest vegetables However, the market was closed for three days from March 5 to 7, which has not been seen over the years, resulting in a sharp increase in the arrival of vegetables on the first day after the market closed, and the crisis of collapsing vegetable prices.

(2) in order to stabilize production and marketing, the Agricultural products Market Trading Law shall add that the central competent authority may, when necessary, implement timely regulatory measures for the operation of the wholesale market.

According to the definition of Article 3 of the Agricultural products Market Trading Law, the Taipei Agricultural products Transportation and Marketing Company is a wholesale market for agricultural products (hereinafter referred to as the market). In accordance with Article 14, paragraph 3, of the same Law, Article 8, paragraph 1, stipulates: "the market shall formulate operation procedures and management rules, which shall be submitted to the local competent authority for approval and implementation, and may carry out planned stock purchase and planned sales." Therefore, the rest day of the Taipei Agricultural products Transportation and Marketing Company was jointly decided by the Taipei City Government, relevant production and marketing organizations and retail market vendors the year before, and submitted to the Taipei City Government for approval and implementation.

The imbalance in production and marketing appeared three days after the market was closed from February 24 to 26. Although the Taipei City Government invited underwriters and four major companies to discuss whether the market would be closed for another three days as planned from March 5 to 7, the original plan to close the market was still maintained after discussion. as a result, some vegetables from some producing areas are unable to alleviate the source of harvested vegetables due to the re-closure of the market, which may aggravate the imbalance.

Last year, there was also an imbalance between supply and demand in the pork market. although the relevant meat wholesale market was also in accordance with Article 8 of the measures for the Management of Agricultural products Wholesale Market, the closing date should be decided by the local government. however, according to the preface to Article 23, item 1 of the Animal Husbandry Law, the central competent authority stipulates: "in order to stabilize the production and marketing of livestock and poultry, the central competent authority may designate livestock and poultry to deal with the following adjustment measures." therefore, this meat imbalance problem. In accordance with Article 23, item 1, of the Animal Husbandry Law, the central competent authority immediately intervened to adjust the closed days of the meat market, so as to solve the imbalance between supply and demand of meat products.

However, the vegetable market was closed for 11 days within a short period of 20 days, resulting in a sharp increase in the volume of vegetables after the market was closed, causing vegetable prices to collapse, and vegetable farmers suffered great losses. however, the central competent authority is still unable to intervene in the decision on whether to shorten the closing day from March 5 to 7. Because of the Agricultural products Market Trading Law and related sub-laws, there is no Article 23, item 1 of the Animal Husbandry Law, and the central competent authority shall implement the relevant regulatory measures in order to stabilize production and marketing.

According to Article 12, paragraph 1, of the Agricultural products Market Trading Law, the wholesale market for agricultural products is a public utility, and the supply of agricultural products involves the rights and interests of "food", which is essential to the people's livelihood. Its operation has a great impact on the production and marketing of agricultural products.

Although the operation of the wholesale market has to be adjusted according to local conditions due to the different types of agricultural products in different places, in order to stabilize the supply of agricultural products, it is necessary for the central competent authority to intervene in the operation of the wholesale market in a timely manner in order to stabilize the supply of agricultural products. It is suggested that the Agricultural products Market Trading Law, with reference to the legislative intent of paragraph 1 of Article 23 of the Animal Husbandry Law, add the central competent authority to stabilize production and marketing and, when necessary, implement relevant regulatory measures for the wholesale market.
