Ministry of Land and Resources reports on the implementation of Land Law Enforcement and Supervision in 2015

The Ministry of Land and Resources held a press conference on September 15 to inform them of the progress of law enforcement and supervision of land and resources in 2015, and announced five cases of violations of laws and regulations under supervision. From January to August this year, departments in charge of land and resources at all levels put on file and investigated 3193 illegal cases in the field of mineral resources, with fines of 235 million yuan; and put on file 39900 cases of illegal land, involving 307300 mu of land, including 99700 mu of arable land. 6.6133 million square meters of buildings were demolished according to law, 12.2141 million square meters of buildings were confiscated, and 824 million yuan was fined. A total of 1094 responsible persons were punished by the party and government discipline, and 39 responsible persons were investigated for criminal responsibility.

At the press conference, Yue Xiaowu, deputy director of the Law Enforcement and Supervision Bureau of the Ministry of Land and Resources, said that in 2015, the Ministry of Land and Resources conscientiously implemented a series of major policies and measures of the State Council, such as stabilizing growth, promoting reform, restructuring, and benefiting the people's livelihood, scrupulously performing their duties and taking the initiative to promote the landing of major policies and projects. We will deepen reform, be determined to innovate, strive to solve the outstanding contradictions and problems we are facing, improve the policies and management of land and resources, and ensure the promotion of investment, consumption and steady growth of land and resources. At the same time, the competent departments of land and resources at all levels adhere to the strictest system of resource protection and conservation, strictly abide by the red line of cultivated land protection, dare to meet hard, strictly enforce the law, stress accountability, and earnestly maintain the order of land and resources management.

In 2014, the Ministry of Land and Resources issued the rules for investigating and dealing with illegal acts of Land and Resources, and departments in charge of land and resources at all levels strictly regulated fair and civilized law enforcement, Yue Xiaowu said. In the 2014 land and mineral resources satellite film law enforcement supervision and inspection carried out this year, 22 provincial governments interviewed the main responsible comrades of 27 cities and 127 counties (districts) governments. From January to August this year, departments in charge of land and resources at all levels listed and supervised a total of 125 illegal cases of land and resources, and publicly reported the results of the investigation and handling of 25 illegal cases of land and resources.

At the press conference, Yue Xiaowu also reported on the latest five illegal cases supervised by the Ministry of Land and Resources. The five cases are: the illegal land occupation case of 13 enterprises in the modern agricultural demonstration zone of Zhongmou County, Zhengzhou City, Henan Province; the illegal land use case of the Management Committee of Langyatai Scenic spot in Chuzhou City, Anhui Province; the illegal land use case of the Economic and technological Development Zone of Red Granite District, Zunyi City, Guizhou Province; the illegal land grant case of the Qinzhou District Government of Tianshui City, Gansu Province; and the illegal mining case of Shendong Tianlong Group Xinjiang Wucaiwan Coal Co., Ltd.

Yue Xiaowu said that the above five cases involved illegal occupation of cultivated land, illegal occupation of agricultural land for non-agricultural construction in the name of facility agriculture, serious infringement on the interests of the masses and illegal exploitation of mineral resources.

"at present, under the new normal of economic development, departments in charge of land and resources at all levels should actively provide services and strictly enforce the law at the same time." Yue Xiaowu put forward four suggestions: first, we should pay attention to giving full play to the overall function of land and resources management, improve the system, improve management, and take the initiative to serve, so as to effectively ensure the reasonable demand for land and minerals under the new normal of economic development, and reduce procedural violations. Second, it is necessary to change the way of law enforcement, strengthen the supervision of daily law enforcement, and "find out in the initial stage and solve the problem in the bud" of illegal land use and mining. Third, we should further implement the measures for Administrative penalties on Land and Resources and the rules for investigating and dealing with illegal acts of Land and Resources, and strictly standardize fair and civilized law enforcement. Fourth, give prominence to the key points and emphasize accountability. We will seriously investigate and deal with illegal acts such as the illegal occupation of agricultural land in the name of "land circulation" for "non-agriculturalization", violating the state's industrial policy, and seriously infringing upon the interests of the masses, and continue to supervise and publicize major typical cases.
