Starting from August 1, 2019, three pesticides have been banned and enterprises that have not obtained pesticide production licenses will face the risk of revoking their pesticide registration certificates.

From August 1, these three pesticides will be banned.

According to the notice No. 2552 of the Ministry of Agriculture and villages, the use of acephate, carbosulfan and dimethoate in vegetables, melons and fruits, tea, fungi and Chinese herbal medicines will be prohibited from August 1, 2019.

The main reason for the prohibition of these three pesticides is that they may degrade and produce highly toxic pesticides methamidophos, carbofuran and omethoate during storage.

Acephate: as an oral insecticide, it is generally used to control a variety of chewable and piercing mouthparts pests and harmful mites and health pests. In that year, as one of the alternative products for the withdrawal of methamidophos, a highly toxic pesticide, it played a certain role. However, in the process of use, the degradation and metabolism of acephate is not optimistic. at the same time, improper storage and use can cause human and animal poisoning.

Dimethoate: it is an internal organophosphorus insecticide and acaricide. It is mainly used for field crops (wheat, rice, etc.). It is suitable for controlling piercing and sucking mouthparts pests on many kinds of crops, such as aphids, leafhoppers, whitefly, latent leaf pests and some scales. it has good control effect and certain control effect on mites. However, when dimethoate is degraded, it produces omethoate, which is banned.

On June 26th, 2019, the European Union issued an official announcement (EU) 2019 up 1090, which decided not to approve dimethoate's application for re-evaluation, which will come into effect on June 29th, 2019.

Carbosulfan: a moderately toxic insecticide and acaricide. It is also one of the substitutes for carbofuran, a highly toxic pesticide. Carbosulfan was banned mainly because of residue problems. When used in vegetables, it is easy to decompose into carbofuran and trihydroxy carbofuran.

Carbosulfan mainly controls rust wall lice, aphids, leaf moths and scale insects in citrus. After being banned, carbosulfan may take over the banner of carbosulfan in the control of rust wall lice, and the control effect will be more excellent.

As can be seen from the above table, among the several insecticides for the control of rust wall lice on citrus, basically all of them use contact and stomach poison, which can kill larvae and adults, but the only one that can kill eggs is lice, which can play a key role in the field of prevention and has a longer lasting effect. this is the advantage of acarbazide.

This kind of enterprise will have its pesticide registration certificate revoked!

Article 63 of the regulations on Pesticide Administration clearly stipulates that if a pesticide production license is not obtained, a pesticide business license is not obtained, or the pesticide registration certificate, pesticide production license or pesticide management license is revoked, the person directly in charge shall not engage in pesticide production or business activities within 10 years.

Case

Recently, the agricultural administrative law enforcement brigade of Dongyang City, Zhejiang Province reported that the city had uncovered a case of unauthorized operation of pesticides.

According to the report, the agricultural administrative law enforcement brigade of Dongyang went to a Qianxiang agricultural management store to inspect unlicensed pesticides and seized more than 600 bottles (bags) of 26 varieties of pesticides on pick-up trucks parked at the door of the agricultural management store.

The store was fined 20000 yuan in November 2018 for operating pesticides without a license, and ordered the person in charge not to deal in pesticides for 10 years. This investigation and punishment is a repeat offense.

In the course of the inspection, because the responsible person refused to admit it and did not cooperate with the law enforcement inspection, the law enforcement brigade sealed up and detained the records of the scene in accordance with the law, and sealed up the pickup trucks and pesticides involved in the case.

At the beginning of the year, the city's agricultural law enforcement brigade carried out a special rectification of unlicensed operation in the pesticide market, and conducted irregular inspections on agricultural material management units in the city that did not obtain pesticide business licenses, and immediately rectified the existing problems, and those who refused to rectify and reform were put on file to investigate and deal with them. By late January, a total of three agricultural stores had been filed with illegal acts of dealing in pesticides without a license. At present, all the cases have been closed, with fines and confiscations totaling 31036 yuan. The person in charge of two of these stores will no longer be allowed to engage in pesticide management activities within 10 years.

After August 1, enterprises that have not obtained the pesticide production license will face the risk of revoking the pesticide registration certificate!

The measures for the Administration of Pesticide production license stipulates that if the pesticide registration certificate has been obtained before the implementation of these measures, but the pesticide production approval certificate or pesticide production license has not been obtained, and it is necessary to continue to produce pesticides, the pesticide production license shall be obtained within two years from the date of implementation of these measures.

The measures for the Administration of Pesticide production license was formally implemented on August 1, 2017, and two years later, that is, August 1, 2019.

For enterprises that have not obtained the pesticide production license within the time limit, is the worst result only that they can not produce pesticides? For enterprises that produce pesticides illegally, is it only the person in charge of the company who is not allowed to engage in pesticide production, management and other work within 10 years?

According to the relevant interpretation, those who fail to obtain the pesticide production license may also face the risk of canceling the pesticide registration certificate, and their enterprises can not apply for pesticide registration within 5 years.

For enterprises or units that produce pesticides or produce fake pesticides without obtaining a pesticide production license, in accordance with Article 52 of the Pesticide Administration regulations (revised in 2017), the competent agricultural department of the local people's government at or above the county level will order it to stop production, confiscate illegal gains, products produced illegally and tools, equipment and raw materials used for illegal production, and the value of illegally produced products is less than 10,000 yuan. In addition, a fine of not less than 50,000 yuan and not more than 100000 yuan shall be imposed, and if the value of the goods is more than 10,000 yuan, the fine of not less than 10 times and not more than 20 times the value of the goods shall be imposed, and the pesticide production license and the corresponding pesticide registration certificate shall be revoked by the license issuing authority. If the case constitutes a crime, criminal responsibility shall be investigated according to law.

At the same time, if a pesticide production enterprise that has obtained a pesticide production license no longer meets the prescribed conditions to continue to produce pesticides, it shall be ordered by the competent agricultural department of the local people's government at or above the county level to make rectification within a time limit; if it refuses to make rectification within the time limit or fails to meet the prescribed conditions, the license-issuing organ shall revoke the pesticide production license.

For enterprises whose pesticide registration certificates and pesticide production licenses are revoked, the persons directly in charge shall not engage in pesticide production or business activities within 10 years. If other pesticide enterprises recruit these personnel to engage in pesticide production and management activities, the pesticide production license and pesticide management license will also be revoked. In addition, for enterprises whose pesticide registration certificates have been revoked, the competent agricultural departments will no longer accept their applications for pesticide registration within 5 years.

In other words, enterprises that have not obtained the pesticide production license before August 1, 2019 will not only face the risk of revoking the pesticide registration certificate if they continue to produce pesticides, but will not be allowed to apply for pesticide registration within five years.

So as of August 1, 2019, must not be engaged in pesticide production work without obtaining the pesticide production license issued by the agricultural authorities?

In fact, not necessarily, according to the "Pesticide production license Management measures", the pesticide production license issued by the original Ministry of Industry and Information Technology of the enterprise will be recognized within the period of validity and can be dealt with before expiration. However, for enterprises with only pesticide registration certificates and no production licenses before, the Ministry of Industry and Information Technology does not recognize them as pesticide production enterprises. Therefore, these enterprises are required to obtain the pesticide production license by August 1, 2019, otherwise the registration certificate will be cancelled.
